  2. 2 "Official action can be taken only on items which appear on the agenda. The Council may adopt, approve, ratify, deny, defer, recommend, or continue any agenda item. The Council may also propose and enact floor amendments to any matter presented before them. When more information is needed to act on an item, the Council may refer the matter to the City Manager or the City Attorney. The Council may also refer items to standing committees of the Council or a board, commission, or authority for additional study. Under certain circumstances, items are deferred to a specific later date or stricken from the agenda entirely."

  7. 7 AUDIENCE PARTICIPATION: Anyone having an item of business to present to the City Council that does not appear on the agenda please come forward at this time. The Mayor and Council will receive comments from audience members. Council may recommend to the individual or group as to what action they should take, i.e., refer the situation to a particular department or person at the city offices. Each speaker will have a 3-minute time limit, each topic will have a 9-minute time limit, and Audience Participation will be limited to 30-minutes in total.
  8. 8 CONSENT AGENDA:
  9. 1. Consider approving two (2) damage claims (recommended for approval) and resolutions authorizing payments for Samuel Laws in the amount of $1,707.27, and Timothy Silver in the amount of $4,348.59. 24-1643
  10. 2. Consider the following damage claims recommended for denial: Dakota Macias in the amount of $250.00, William Chewning in an unstated amount, and Paulla Smith in the amount of $450.49. 24-1642
  11. 3. Consider approving a Professional Services Agreement with Dr. Robert William Worden, D.O., to work as the Physician Medical Director for the Emergency Communications and Lawton Fire Department. 24-1600
  12. 4. Consider and take action on approving a Professional Services Agreement with Worth Hydrochem of Oklahoma in the amount not to exceed $463,213 for services to conduct reverse osmosis(RO) and green sand filtration pilot and provide an engineering report of water treatability. 24-1624
  13. 5. Consider approving a Service Agreement with Arts for All, Inc., subject to approval by Arts for All, Inc., and allocating an amount up to $35,000.00 from the PROPEL CIP under section A.4.B (2019 CIP Summer Youth Program Funding) to fund the Summer Arts Institute for the Underserved hosted by Arts for All in conjunction with Lawton Public Schools. 24-1667

Consider renewing a professional services agreement retaining the law firm of Hawkins, Delafield & Wood LLP as Disclosure Counsel in connection with the issuance of the City’s General Obligation and other Bonds that must comply with applicable municipal securities regulations including continuing disclosure requirements regarding the City’s financial statement and annual financial information/operating data relating to each Bond Issue. 24-1630
  15. 7. Consider adopting a Resolution authorizing the installation and/or removal of traffic control measures at the intersection of West Gore Boulevard and 4th Street. 24-1666
  16. 8. Consider adopting Street Light Resolution No. 507 to authorize the installation of flood lights and street lights at the locations listed in the resolution: Westside of Elmer Thomas Park. 24-1670

Consider renewing an agreement for professional services between the City of Lawton and Doerner, Saunders, Daniel & Anderson, LLP for their expertise with immigration law relating to employment visas for select City of Lawton employees and authorize the Mayor and City Clerk to execute the Agreement. 24-1629
  18. 10. Consider renewing the professional services agreement with McAfee & Taft for legal services related to the City’s pension system, employment/labor related issues and other areas as requested by the City and authorize the Mayor and City Clerk to execute the Agreement. 24-1641

  20. 12. Consider awarding a contract in the amount of $11,347,737 to Southwest Water Works, LLC of Oklahoma City, Oklahoma, for the construction of Map 11 Waterline Replacement Project Phase I PU2309 to rehabilitate approximately 31,000 linear feet of existing 6, 8, and 12-inch waterlines. 24-1635
  21. 13. Consider awarding contract (CL24-020) HVAC Services to T&M Solutions, LLC for Building Groups #1, 4, and 5 and to Miller Noble Heating & Air Conditioning for Building Group #2 and 3. 24-1649
  22. 14. Consider awarding contract RFPCL24-016 for the City of Lawton Property and Terrorism Insurance to INSURICA Insurance Services LLC underwritten by OMAG and Lloyd’s of London, for a total cost of $776,981.00 24-1655

Consider and ratify the action of the Lawton Water Authority approving a Resolution of Reimbursement 24-XXXX to the 2019 Propel CIP Water and Wastewater ½ cent to utilize funds which will be reimbursed with proceeds from DWSRF Loan ORF-24008-DW in the amount of $11,347,737.00 scheduled to close in late June. . 24-1634
  24. 16. Consider awarding contract CL24-021 Bulk Fuel Delivery for Public Works to Glenn Oil Company for Lakes Lawtonka and Ellsworth sites, Landfill, Medicine Park Water Treatment Plant, Wastewater Treatment Plant, and all emergency generator sites. 24-1650
  25. 17. Consider approving an indefinite Sponsorship Agreement with the Board of Regents of the University of Oklahoma, on behalf of the Oklahoma Nutrition Information and Education Project (ONIE), for the City of Lawton to waive fees and provide necessary resources for the Let’s Get Moving Lawton event on an annual basis. 24-1639
  26. 18. Consider approving construction plans for an 8-inch sanitary sewer line to serve a proposed Dollar General to be located at 7010 SW Lee Blvd, Lawton, OK 73505, subject to the conditions listed. 24-1644
  27. 19. Consider and approve plans authorizing construction of a sanitary sewer main in the Tropes five acer addition, south side of SW Lee Boulevard, west of SW 24th Street. The sewer main services a number commercial business in the project area. The Sanitary sewer main is to be constructed by the Sewer System Construction Division 6501 within the Public Utilities Department. 24-1622

Consider accepting temporary construction easements and permanent utility and access easements from Cameron University, Taybar Lawton, LLC, JC and Tammy Gail Grayson Living Trust, Jodie and Angela Reece Living Trust, KMC Investments, LLC, Physical Therapy Solution PC, GCG Properties, LLC, Aryaction Realty, LLC, 904 SW 38, LLC, and Department of Mental Health and Substance Abuse Services Real Property Trust for the SW 38th Street Waterline Project # EN2102A, and authorizing the Mayor and City Clerk to execute the documents. 24-1591

In recognition of the McMahon Foundation’s contributions in support of the construction of the Playground in the Park, and the All-Inclusive expansion scheduled for completion by June 2024 at Elmer Thomas Park, consider approval of the naming of the playground areas as “McMahon Playground in the Park.” 24-1545

  31. 31 BUSINESS ITEMS:

Hold a public hearing to consider a request for a Use Permitted on Review to allow a private medical facility to be in a Public Facility (P-F) zoning classification district, more particularly located at 4814 NW Floyd Ave, Lawton, OK 73505; and take appropriate action as deemed necessary. 24-1645
  33. 24. Consider revoking the Small Cell Wireless Facility Revocable Permit for the Small Cell Wireless Facility located at 6432 NW Arrowhead Drive and take action as necessary. 24-1648
  34. 25. Consider approving an ordinance pertaining to Utilities, amending Section 22-1-4-144, Division 22-1-4, Article 22-1, Chapter 22, Lawton City Code 2015, by amending the percentage of the landfill gate fee to be three-fifths to the landfill gate fee account, one-fifth to the wards and one-fifth to solid waste to fund the litter abatement operations near the landfill, providing for severability, establishing an effective date and allowing for floor amendments. 24-1618
  35. 26. Consider approving an ordinance pertaining to buildings, construction and housing by amending Section 6-1-1-113, Division 6-1-1, Article 6-1, Chapter 6, Lawton City Code, 2015, by removing the permit types of multi-family dwellings and institutional/assembly permit types, adding language to allow for a fee to be charged to the applicants that utilize the third party plan review, providing for severability, establishing an effective date and allowing for floor amendments. 24-1619

Consider approving an ordinance pertaining to buildings, construction and housing, by creating Sections 6-1-1-107.3 and 6-1-1-107.4, Division 6-1-1, Article 6-1, Chapter 6, Lawton City Code, 2015, by adding language for contractors to call in emergency and photographic inspections, establishing a fee for said inspections, providing for severability, providing for codification, establishing an effective date and allowing for floor amendments. 24-1620
  37. 28. Consider approving a resolution amending Appendix A, Schedule of Fees and Charges, Lawton City Code, 2015, pertaining to Chapter 6, Buildings, Construction and Housing, by amending Article A-6-1, Building Code. 24-1621
  38. 29. Consider approving an Ordinance pertaining to Building, Construction and Housing, by amending Section 6-7-1-704, Division 6-7-1, Article 6-7, Chapter 6, Lawton City Code, 2015, by amending the duties of the Building Development Appeals Board to include variances to construction of boathouses and appeals for contractors that have been removed from emergency and/or photographic inspection process, providing for severability, establishing an effective date and allowing for floor amendments. 24-1657

Consider approving a resolution amending Appendix A, Chapter A-19, Article A-19-5, Schedule of Fees and Charges, Lawton City Code, 2015, by adding an administrative fee of $1000.00 for variance requests pertaining to the construction of boathouses, re-aligning the numbering of said section, allowing for any floor amendments, and authorizing the Mayor and City Clerk to execute the resolution. 24-1656

Consider approving an amendment to Council Policy 1-6 Council Rules of Procedure, requiring submission of a request to speak form during audience participation, establishing limits during audience participation for those who have been removed, clarifies audience members may be called upon during a public hearing, and provides updated formatting of the Policy. 24-1611
  41. 32. Discuss and take necessary action on changing the time of regularly scheduled City Council meetings to 6:00 PM, including establishing an effective date for this change, and directing staff to post any required notices. 24-1651

  44. 44 EXECUTIVE SESSION ITEMS:
  45. 34. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss a pending action with Oklahoma Department of Environmental Quality concerning a Notice of Violation issued by ODEQ to the City on February 14, 2024, in relation to the City of Lawton Municipal Solid Waste Landfill and the FY 2022 and FY 2023 financial assurance mechanism update, local government test, not having been submitted by December 31, 2022 and December 31, 2023, respectively, and , if necessary, take appropriate action in open session. 24-1627

  47. 47 The City of Lawton encourages participation from all of its citizens. If participation at any public meeting is not possible due to a disability, notification to the City Clerk at (580) 581-3305 at least 48 hours prior to the scheduled meeting is encouraged to make the necessary accommodations. The City may waive the 48 hour rule if interpreters for the deaf (signing) is not the necessary accommodation."
