Mgmt.-1st reading- Susp & Adopt 08-19-2025- Elmore/ ) AUTHORIZING AND APPROVING A FUND TRANSFER IN THE AMOUNT OF NINETY-FIVE THOUSAND AND 00/100 DOLLARS ($95,000.00) FROM UNAPPROPRIATED MONIES IN THE GENERAL FUND (101) TO THE ACCRUED BENEFIT RESERVE FUND (505); AUTHORIZING AND APPROVING A SUPPLEMENTAL APPROPRIATION IN THE AMOUNT OF NINETY-FIVE THOUSAND AND 00/100 DOLLARS ($95,000.00) TO THE ACCRUED BENEFIT RESERVE EXPENSE ACCOUNT 505.000.51000. <br> <br>WHEREAS, the Accrued Benefit Reserve Fund is used for employee payouts for the designated benefits that belong to the employee through their union contract or by codified ordinance upon separation of employment from the City of Whitehall, and<br> <br> WHEREAS, the fund balance is currently low and requires additional funding; NOW, THEREFORE,<br> <br> <br> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WHITEHALL, OHIO:<br> <br>SECTION 1: That the Council of the City of Whitehall, approves a fund transfer in the amount ninety-five thousand and 00/100 dollars ($95,000.00) from unappropriated monies in the General Fund (101) to the Accrued Benefit Reserve Fund (505) and approves a supplemental appropriation in the amount of ninety-five thousand and 00/00 dollars ($95,000.00) to the Accrued Benefit Reserve Fund Expense Account (505.000.51000),<br> SECTION 2: That the City Auditor is hereby authorized to draw his warrant upon the Treasurer of the City for these funds for the stated purpose. SECTION 3: That this Ordinance shall go into full force and effect immediately upon its passage and approval by the Mayor. Of the Whole -3rd reading- Adopt 09-16-2025- / )<br> <br>AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT FOR THE COLLECTION, TRANSPORTATION AND DELIVERY FOR DISPOSAL OR PROCESSING OF RESIDENTIAL SOLID WASTE, RECYCLABLE MATERIALS AND YARD WASTE GENERATED WITHIN THE CITY OF WHITEHALL, FRANKLIN COUNTY, OHIO BETWEEN THE CITY OF WHITEHALL AND LOCAL WASTE SERVICES, LTD. WHEREAS, pursuant to Sections 715.43 and 3707.43 of the Ohio Revised Code, the City may enter into written contracts with independent contractors to establish collection systems and designate solid waste facilities as may be necessary or appropriate to provide for the safe and sanitary management of solid waste, including recyclable materials and yard waste, generated within the City; and WHEREAS, it is in the best interests of the City and its residents that the City arrange for the collection, transportation and delivery for disposal or processing of all solid waste, recyclable materials and yard waste generated at residential units, City facilities and during special events located within the City from a single collection contractor on an exclusive basis (“Collection Services”); and WHEREAS, Section 933.13 of the City of Whitehall Codified Ordinances authorizes the Mayor to prepare specifications and issue a franchise for the collection, transportation and disposal or processing of residential solid waste, recyclable materials and yard waste of residents of the City for a period not to exceed five years; and WHEREAS, on March 20, 2025 and March 27, 2025, the City, as part of a joint bid process with several communities located within the jurisdiction of the Solid Waste Authority of Central Ohio (“2025 Solid Waste Consortium”), invited, through advertisement in The Daily Reporter, qualified providers of the Collection Services to submit bids to provide such Collection Services; and WHEREAS, following the May 1, 2025 official opening of the bids by the 2025 Solid Waste Consortium and consideration of bids for Collection Services, the City determined that Local Waste Services, Ltd. is qualified and submitted the lowest and best bid to provide the Collection Services to the City; and<br> <br>WHEREAS, the City and Local Waste Services, Ltd. have preliminarily agreed upon terms and conditions for the Collection Services in conformance with the bid documents, which allows for: status quo operations; billing; and the collection of an administrative and operational fee for implementing and maintaining solid waste and recycling collection containers to be owned by the City; and<br> <br>WHEREAS, Council wishes for the City to enter into the AGREEMENT FOR THE COLLECTION, TRANSPORTATION AND DELIVERY FOR DISPOSAL OR PROCESSING OF RESIDENTIAL SOLID WASTE, RECYCLABLE MATERIALS AND YARD WASTE GENERATED WITHIN THE CITY OF WHITEHALL, FRANKLIN COUNTY, OHIO (“the Agreement”) with Local Waste Services, Ltd.; and<br> <br>WHEREAS, there are administrative and operational costs associated with the solid waste and recycling collection system that will be incurred by the City and should be paid by residents benefiting from collection services; and WHEREAS, the City may, pursuant to the Ohio Constitution Article 18, Section 3 and Sections 715.37 and 715.43 of the Ohio Revised Code, adopt ordinances requiring its residents who accumulate solid waste to use municipal garbage collection services and pay a reasonable fee; and WHEREAS, the City has determined a monthly fee of $0.75 per unit is a reasonable amount to fund the administrative and operational costs of the collection system incurred by the City. NOW, THEREFORE,<br> <br> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WHITEHALL:<br> <br>SECTION 1: That the Mayor is hereby authorized to execute the Agreement between the City and Local Waste Services, Ltd., which shall be in substantially the same form as Attachment A. <br> <br>SECTION 2: That this Council further hereby authorizes the Mayor, the Director of Development and Public Service and other appropriate officers of the City to take any other actions as may be necessary and appropriate to execute and carry out the terms of the Agreement, including the implementation of a cart collection system. SECTION 3: WHEREFORE, this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
