Mgmt.–1st Reading-SUSP & ADOPT 09/01/2026-Elmore/ )AUTHORIZING AND APPROVING A FUND TRANSFER IN THE AMOUNT OF SIXTY-EIGHT THOUSAND FIVE HUNDRED SEVENTY-SIX AND 09/100 DOLLARS ($68,576.09) FROM UNAPPROPRIATED MONIES IN THE GENERAL FUND (101) TO THE DEBT SERVICE FUND (401). <br> <br>WHEREAS, the City of Whitehall, Ohio (the "City") made renovations to City Hall, the Police and Fire Department buildings and the Service Department garage, which renovations included energy efficiency upgrades, and financed those improvements through a lease purchase agreement with Huntington Public Capital Corporation, originated in 2017, in the original principal amount of One Million Six Hundred Thirty-One Thousand Seven Hundred Seventy-Two and 00/100 Dollars ($1,631,772.00) (the "Lease"); and<br>WHEREAS, the Lease is repayable in semiannual installments payable on the twenty-ninth day of April and the twenty-ninth day of October in each year, with final payment due April 29, 2032; and<br>WHEREAS, the installment coming due October 29, 2026 is in the amount of Sixty-Eight Thousand Five Hundred Seventy-Six and 09/100 Dollars ($68,576.09), composed of principal in the amount of Fifty-Seven Thousand Six Hundred and 00/100 Dollars ($57,600.00) and interest in the amount of Ten Thousand Nine Hundred Seventy-Six and 09/100 Dollars ($10,976.09), and the outstanding principal balance under the Lease immediately following that installment will be Six Hundred Ninety-Nine Thousand Three Hundred Seventy-Two and 00/100 Dollars ($699,372.00), all as set forth on Exhibit A attached hereto and incorporated herein; andWHEREAS, Ordinance 119-2025 appropriated monies in the General Fund (101) for the purpose of repayment of the Lease, and sufficient unencumbered appropriation authority remains available for the transfer authorized herein; andWHEREAS, Section 5705.09(C) of the Ohio Revised Code requires each subdivision to establish a bond retirement fund for the retirement of serial bonds, notes and certificates of indebtedness, Section 5705.10(I) of the Ohio Revised Code requires that money paid into a fund be used only for the purposes for which that fund is established, and the Auditor of State accordingly directs that debt charges on bonds, notes, loans, capital leases and other long-term obligations of the City be paid from the Debt Service Fund (401); andWHEREAS, Section 5705.14(A) of the Ohio Revised Code authorizes the transfer of monies from the general fund to any other fund of a subdivision by ordinance of the taxing authority, and no approval of the Tax Commissioner or of the court of common pleas under Section 5705.16 of the Ohio Revised Code is required for a transfer made under that division; andWHEREAS, the City Auditor, as Chief Fiscal and Accounting Officer of the City, has determined that the monies proposed to be transferred are in the treasury and are in the unencumbered balance of the General Fund (101), free from any obligation or certification then outstanding; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WHITEHALL, OHIO: SECTION 1: That the Council of the City of Whitehall hereby approves and authorizes a fund transfer in the amount of Sixty-Eight Thousand Five Hundred Seventy-Six and 09/100 Dollars ($68,576.09) from the unencumbered balance of the General Fund (101) to the Debt Service Fund (401), pursuant to Section 5705.14(A) of the Ohio Revised Code. SECTION 2: That the City Auditor is hereby authorized and directed to record the transfer authorized herein and to draw his warrant upon the Treasurer of the City for these funds for the stated purpose.
