The Board held a hearing at 11:00 a.m. on Case File 2606HC141 and received the following comments: a) Introduction by Eric Nolan, Zoning Administrator. b) Comments by Dale Phillips, applicant for the variance permit. c) Comments by Jimmy Fierson, opposition to the variance permit. d) Rebuttal by Mr. Phillips After full discussion, the Board adopted an ORDER approving the appeal with conditions. The clubhouse is granted a variance of 3.7 feet allowing the clubhouse to remain 11.3 feet from the property line as long as all of the siding is removed from the clubhouse making it an open-sided covered structure and granted a 1 foot variance for the shed/garage to allow it to be 14 feet from the property line instead of the required 15 feet. Any part of the structure that is closer than 14 feet from the property line must be removed. All permits must be applied for, granted, inspected and finalized to satisfy this case. The subject property is located at 5409 Tuxachanie Drive in an R-2 (Medium Density Residential) District. The ad valorem tax parcel number is 1306D-01-019.000.
