A public hearing was held at 10:00 a.m. to consider the appeal of Case File No. 2212HC217, concerning a request for extension of a previously approved Conditional Use Permit for property located at 19295 Hwy 53 (Tax Parcel No. 0606L-01-001.001), zoned R-1 (Low-Density Residential), to allow for a 71-lot single-family residential subdivision on a 48-acre parcel. The Board received the following comments: a) Presentation by Eric Nolan, Zoning Administrator; b) Comments by attorney Bill Williams, representing the applicant, Steven Day, in favor of the extension; c) Comments by Angel Middleton, in opposition; d) Rebuttal by Bill Williams. After full discussion, the Board adopted an ORDER directing that Case File No. 2212HC217, be remanded to the Planning Commission for further evaluation due to a procedural error in the prior denial, which was based on criteria applicable to a new application rather than an extension, provided that the request reflects the same number of lots as approved in the originally granted Conditional Use Permit.
