Abandonment of Right-of-Way and Easements/ Montgomery Park BLW Attorney Kevin Moore has reviewed the attached Quitclaim Deed between the Marietta Board of Lights and Water and the Marietta Housing Authority relating to the abandonment of Right-of-Way and Easements in Montgomery Park which has been acquired by Traton Homes for redevelopment. Staff recommends authorization for the BLW Board Chairman to execute this Quitclaim Deed. Mayor Tumlin previously disclosed that Smith, Tumlin and McCurley and Patrick, P.C. performed legal services in real estate for the Marietta Housing Authority (MHA) including the current land purchase contract with Traton. This presents a conflict while still owned by the MHA.
