707 ANASTASIA AVENUE Violation Description - Maintenance Requirements Sec 34-203(a) - Sec. 34-203. - Maintenance requirements.(a)Properties subject to this article shall be kept free of weeds, overgrown brush, dead vegetation, trash, junk, debris, building materials, any accumulation of newspapers, circulars, flyers, notices, except those required by federal, state or local law, discarded personal items including, but not limited to, furniture, clothing, large and small appliances, printed material or any other items that give the appearance that the property is abandoned.(Code 2006, § 34-166; Ord. No. 2011-07, § 2(34-66), 6-7-2011; Ord. No. 2018-20, § 2, 6-12-2018). Code Enforcement Officer Comments - Failure to maintain abandoned property. You are in violation Section 34-203 by allowing the following conditions, which are also violations of the following sections of the City Code: 1. Mosquito and Rat Infestations. Exterior property areas have sources of insect, vermin, and rodent breeding, harborage, and infestation and is harboring rat and mosquito infestations. This is a violation of § 34-203(c) and (h) of the City Code. (See also §§ 105-224 and 105-227 of the City Code.) 2. Dirty structure. The brick façade of the house, the front porch, and the pool deck are dirty. The side porch is damaged and dirty. This is a violation of § 34-203(h) of the City Code. (See also §§ 105-255 and 105-278 of the City Code.) 3. Damaged driveway. The driveway of the house is cracked and damaged. This is a violation of § 34-203(h) of the City Code. (See also § 105-226 of the City Code.) 4. Boarded windows. Three windows have been boarded up. This is a violation of § 34-203(h) of the City Code. (See also § 105-250 and 105-255 of the City Code.) 5. Damaged Roof. Damaged roof with a blue tarp, and rotted, loose, and warped wood decking. This is a violation of § 34-203(h) of the City Code. (See also §§ 105-250, 105-252, 105-278, 105-89(10)(a) of the City Code.) 6. Damages Eaves. Damaged wooden eaves that lack paint or other protective coating. Damaged wood columns in the rear patio. This is a violation of § 34-203(h) of the City Code. (See also §§ 105-251 and 105-275 of the City Code.) 7. Trash, Debris, and Rubbish. There is trash and debris throughout the property consisting of used brick and pavers, a full and open black plastic garbage bag full of garbage, a roll of construction material, used roof insulation, plastic buckets, a blue plastic hose, plastic bottles, plastic bags, plastic lids, used cardboard boxes, paper, rotted wood on the pool cover. This is a violation of § 34-203(a)(c)(d)(e) and (h) of the City Code. (See also § 5-506 of the City Zoning Code) 8. Dead and (See also §§ 34-55 and 105-220 of the City Code.) 9. Outdoor Storage. Outdoor storage of construction materials, bags of cement or other construction materials, plastic buckets of construction materials This is a violation of § 34-203(h) of the City Code. (See also § 5-506 of the City Zoning Code) 10. Dead and overgrown vegetation. Dead leaves and overgrown vegetation in the backyard. This is a violation of § 34-203(a)(c)(d)(e) and (h) of the City Code. (See also § 34-55 of the City Code.) 11. Stagnant Water and Swimming Pool. Stagnant water with a layer of algae on the swimming pool cover and stagnant water in the swimming pool, which are both a breeding ground for mosquitoes. This is a violation of § 34-203(f) and (h) of the City Code. (See also §§ 34-55, 105-228, and 105-89(8) of the City Code.) 12. Unsecured Pool. The pool lacks a self-closing gate and latch and is not surrounded by a four-foot wall. This is a violation of § 34-203(h) of the City Code. (See also § 3-308 of the City Zoning Code and § 105-89(8) of the City Code.) 13. Expired permits/Unfinished building/Work without a permit. BL-21-05-7164 for the roof insulation expired on 5-23-22 and the building has not been completed within a year and ZONC-24-02-1779 for painting the Structure will expire on 6-19-26; interior demolition of ceiling, walls, and hanging electrical fixtures, and exterior demolition and construction work under roof patio without a permit. This is a violation of § 34-203(h) of the City Code. (See also § 105-26 of the City Code and 105.1 of the Florida Building Code and 105-89(3) of the City Code and §§ 14-202.7(A)(1) and (D) and 14-202.8 of the City Zoning Code.) 14. Sidewalk and swale not maintained. The sidewalk is cracked and dirty and the sidewalk and swale have an accumulation of dead leaves. This is a violation of § 34-203(h) of the City Code. (See also §§ 58-48 and 62.151 of the City Code). Remedy - 1. Mosquito and Rat Infestations. Property must be kept free from sources of insect, vermin, and rodent breeding, harborage, and infestation, which constitute a serious threat to the public health, safety, and welfare. Immediate corrective measures must be taken to remove insect, rodent, or vermin breeding areas and the infestations, to wit: (1) the rat infestation and the trash and debris that harbors them and (2) the mosquito infestation and the stagnant water on the swimming pool cover and the stagnant water in the swimming pool and any trash and debris that may collect rainwater. 2. Dirty structure. Clean the brick façade of the house, the front porch, and the side patio and apply for, obtain, and pass final inspection on all required Permits to repair the side patio. 3. Damaged driveway. Apply for, obtain, and pass final inspection on all required Permits to repair the driveway. 4. Boarded windows. Apply for, obtain, and pass final inspection on all required Permits to repair or replace the windows. 5. Damaged Roof. Apply for, obtain, and pass final inspection on all required Permits to repair the roof. 6. Damages Eaves. Apply for, obtain, and pass final inspection on all required Permits to repair the eaves and damages wood columns. 7. Trash, Debris, and Rubbish. Remove all trash, debris, and rubbish. 8. Outdoor Storage. Remove all outdoor storage or place it in a permitted storage area that is enclosed on all sides with a solid or louvered masonry wall, not less than six feet in height, with necessary openings. 9. Dead and overgrown vegetation. Consistently remove the dead and overgrown vegetation. 10. Stagnant Water and Swimming Pool. Consistently remove the stagnant water and algae from the swimming pool cover and remove the stagnant water from the swimming pool or service the pool, so that its water runs and is not allowed to stagnate. 11. Unsecured Pool. Apply for, obtain, and pass final inspection on all required Permits to properly enclose and secure the pool. 12. Expired permits/Unfinished building/Work without a permit. Re-open and apply for, obtain, and pass final inspection on all required Permits to remove or complete the work, as applicable. 13. Sidewalk and swale not maintained.
