Consider recommendations regarding Fiscal Year (FY) 2022-2023 Department of State Hospitals (DSH) Felony Incompetent to Stand Trial (IST) Expenditure Plan and FY 2023-2024 Penalty Payment, as follows: (4/5 Vote Required) a) Approve the FY 2022-2023 Department of State Hospitals Felony Incompetent to Stand Trial Expenditure Plan for submittal to Department of State Hospitals, and return of FY 2022-2023 Penalty Payment; b) Approve Budget Revision Request No. 0010372 to establish appropriations of $155,250.00 in General County Programs General Fund for Services and Supplies funded by release of Committed AB 199 fund balance to make the FY 2023-2024 Penalty Payment and establish appropriations of $414,000.00 for the return of the FY 2022-2023 penalty payment from DSH); and c) Determine that the above action is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3), finding that the activities are covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment, and where it can be seen with certainty that there is no possibility that the activities in questions may have a significant effect on the environment, the activities are not subject to CEQA.
