Environmental Management Department recommending the Board Approve the following: 1) Accept a grant award from the State of California, Department of Resources Recycling and Recovery, SB 1383 Local Assistance Grant Program, OWR4 Cycle, Fiscal Year 2022-23, in the amount of $416,857 for the term beginning upon award and acceptance of funds through April 1, 2026; 2) Authorize the Environmental Management Department Director to execute the Grant Agreement and all grant-related documents including, but not limited to, amendments, requests for payment, reports, and all associated documents necessary to secure grant funds and implement the approved grant program; 3) Make findings in accordance with Section 3.13.030 (B) of the County Ordinance that specialty skills and qualifications not expressly identified in County classifications are involved in the performance of the work; 4) Find that this Contract is exempt from competitive bidding in accordance with Procurement Policy C-17, 3.4 Sole Source, Sections 2 and 3; and 5) Approve and authorize the Chair to sign Agreement 8726 with Breathe CA to assist with meeting regulation requirements of SB 1383 for an amount of $166,305.03 and a term upon execution and ending June 30, 2025; FUNDING: SB 1383 OWR3/OWR4 Grants.
