Pima County Comment on Proposed Rule, U.S. Census Bureau Discussion/Direction/Action: Directing the County Administrator to submit Public Comment on behalf of Pima County in opposition to the Proposed Rule currently up for public review by the U.S. Census Bureau, concerning conduct of the decennial Census. The U.S. Department of Commerce, Bureau of the Census, has published a two-part Proposed Rule that would influence how the 2030 decennial Census would be conducted, to: (1) dictate that only US Citizens and Legal Permanent Residents be counted, even though the Census Bureau’s constitutional mandate (14th Amendment, Section 2) is to count “the whole number of persons in each State” for congressional apportionment purposes; and (2) to eliminate the gathering of demographic data including race, ethnicity and sexual orientation on the 2030 Census and “any other questionnaire used for the enumeration of the population.” The Public Comment period ends at 11:59 PM EST on November 2, 2026. The Proposed Rule, “Decennial Census of the Population of Americans; Proposed Residence Criteria and Proposed Regulations for Demographic Questions,” is published here: https://www.regulations.gov/docket/USBC-2026-0628.
