LA JOLLA VISTA PEDESTRIAN WALKWAY RECOMMENDATION: The City Council has options to consider: Option 1: Retain the existing stipulation, but direct staff to revise, following state and local laws, the PAD Zoning and Development Agreement to state that the proposed perimeter wall be constructed to not allow through pedestrian access, or; Option 2: Direct staff to proceed, following state and local laws, with a PAD zoning and Development Agreement amendment to remove the pedestrian path stipulation, or; Option 3: Take no action. This would result in the existing PAD stipulation and Development Agreement requirements remain intact thus ensuring the sidewalk between La Jolla Vista and Durango St. is constructed. Staff recommendation is option 3. PURPOSE: During the Planning and Zoning Commission meeting on October 19, 2016 and the City Council meeting held on November 14, 2016, a number of Sweetwater Estates residents (Maricopa County), who live across from the future La Jolla Vista neighborhood, expressed concern about the planned pedestrian walkway that will connect the two neighborhoods. While the current case did not involve the parcel the residents were concerned about, three Council members signed a statement requesting that staff move forward to remove the stipulation requiring the pedestrian path connection. This action will allow Council to discuss the request, review options, the required process, staff time, and cost investment in order to provide direction to staff to proceed or not.
