RIGHT OF WAY LICENSE AND TEMPORARY CONSTRUCTION AND ACCESS EASEMENT TO THE CANTAMIA AT ESTRELLA MOUNTAIN COMMUNITY ASSOCIATION RECOMMENDATION: 1. Approve the Temporary Construction and Access Easement to CantaMia at Estrella Community Association, Inc. attached to this COAC and authorize its immediate execution by the City Manager. 2. Approve the Right-of-Way License to the CantaMia at Estrella Mountain Community Association, Inc. attached to this COAC subject to CantaMia Estrella Community Association, Inc., entering into an operations agreement acceptable to the City that sets forth the terms for the City providing reclaimed water to CantaMia. The City Manager is authorized to execute the attached Right-of-Way following the execution of the operations agreement referred to herein. PURPOSE: The CantaMia at Estrella Mountain Community Association, an Arizona non-profit company “Association” has requested the City provide a Right of Way License “License” and a Temporary Construction and Access Easement “TCE” to the Association. The License and Easement are required for an underground reclaimed water line which will be placed in Rainbow Valley Road and on the City’s Rainbow Valley Wastewater Treatment Property “WTP” for the transmission of effluent water to the CantaMia Lakes.
