ENVIRONMENTAL ACCESS AND REMEDIATED GROUNDWATER REUSE AGREEMENT RECOMMENDATION: ADOPT RESOLUTION 14-1592 AUTHORIZING AND DIRECTING THE CITY MANAGER OR DESIGNEE TO EXECUTE AN ENVIRONMENTAL ACCESS AND REMEDIATED GROUNDWATER REUSE AGREEMENT WITH GOODYEAR TIRE & RUBBER COMPANY; PROVIDING AUTHORIZATION AND DIRECTION TO THE CITY MANAGER OR HIS DESIGNEE TO TAKE ALL ACTIONS AND EXECUTE ANY AND ALL DOCUMENTS NECESSARY TO CARRY OUT THE INTENT OF THE RESOLUTION AND THE ENVIRONMENTAL ACCESS AND REMEDIATED GROUNDWATER REUSE AGREEMENT; AND PROVIDING FOR AN EFFECTIVE DATE. PURPOSE: Since groundwater contamination was found in the vicinity of the Phoenix Goodyear Airport in 1981, the City has worked cooperatively with state and federal authorities to identify the sources of the contamination, protect nearby potable water wells from the contamination, and assure that the groundwater is restored to its earlier quality. Since the issuance of the Consent Decrees with the United States (“U.S.”), Goodyear Tire & Rubber Company agreed to conduct remedial efforts at the Phoenix PGA-S site. These ongoing remedial treatment efforts have required, and will continue to require, that Goodyear Tire & Rubber Company install wells, pipelines and facilities in the City of Goodyear on public and private property.
