This is a request to approve an amendment to the Sun-DS Farms Final PAD to replace 28 acres of Neighborhood Commercial and Office land uses with 22 acres of Low Density Residential land use and six acres of Commerce Center land use. The applicant, Kevin Kugler, representing RBF Consulting was present. Chairman Schlosser opened the public hearing. Steve Careccia, Planner III, presented the Staff Report for the request to approve an amendment to the Sun-DS Farms Final PAD. This request is an amendment to the Sun-DS Farms Final PAD to revise certain land uses within the PAD. The overall Sun-DS Farms PAD consists of 160 acres along Estrella Parkway, Lower Buckeye, and Elwood. The Final PAD was approved in 2008 for 160 acres, including 85 acres of residential land use, 10 acres of Office Condo land use, 41 acres of Business Park land use, 18 acres of Neighborhood Commercial land use and six acres of parks. The Sun-DS Farms PAD is stipulated to a maximum yield of 406 dwelling units. The amendment replaces commercial land use with residential land use adjacent to the existing residential community of Estrella Vista. The applicant feels that the residential use of this location was in higher demand than commercial uses. Chairman Schlosser inquired about the notifications to the neighbors. Mr. Careccia confirmed that notices were sent to all neighbors located within 500 feet of the property. Commissioner Hamilton was concerned that the Developer's Report received some concerns regarding Estrella Vista "cut though" and asked Mr. Careccia to explain the changes that were made to improve the situation. Mr. Careccia explained that the roads in question are not off set whereas in the past, they were lined up. This would have created a convenient pass through for non-residents who were using Sun-DS Farms to get to the school. By off setting the road, the applicant felt that it would deter non-residents. At the time of the initial request in 2008, the residents agreed to this change. The proposed PAD Amendment is consistent with the land uses designated for this property by the General Plan. The limited size of the amendment area does not require any amendments to the General Plan. Staff did receive several inquiries on the project. No opposition to the project has been received. The residents appeared to be pleased with the changes. The proposed PAD Amendment will be compatible with the residential and industrial land uses planned and existing in the surrounding area. The amendment replaces commercial land use with residential land use adjacent to the existing residential community of Estrella Vista. The change of six acres of Office Condo land use to Commerce Park land use will not adversely affect the surrounding area. This area is adjacent to Estrella Parkway, and not near any existing residential development. Staff supports the proposed PAD Amendment and recommends that the application be approved, subject to the recommended stipulations. Chairman Schlosser opened the public hearing.
