- 7 AUDIENCE PARTICIPATION: Anyone having an item of business to present to the City Council that does not appear on the agenda please come forward at this time. The Mayor and Council will receive comments from audience members. Council may recommend to the individual or group as to what action they should take, i.e., refer the situation to a particular department or person at the city offices. Each speaker will have a 3-minute time limit, each topic will have a 9-minute time limit, and Audience Participation will be limited to 30-minutes in total.
- 8 CONSENT AGENDA:
- 1. Consider and take appropriate action with respect to a resolution of the Lawton City Council, authorizing application for a State Designated ARPA Grant in the amount of $2 million for the rehabilitation of Gondola Lake Dam and authorize the Mayor and City Clerk to execute the application documents.
- 2. Consider adopting a resolution authorizing Traffic Control Measures with the installation of two (2) Speed Tables at the locations of midblock on the 1100 block of NW 61st Street and midblock on the 900 block of 61st Street.
- 3. Consider adopting a resolution authorizing Traffic Control Measures with the installation of a DEAD END or NO OUTLET sign at the corner of NW Tomlin Circle and NW Homestead Drive.
- 4. Consider adopting a resolution authorizing Traffic Control Measures with the installation of a STOP AHEAD sign east of NW 40th street.
- 5. Consider adopting a resolution authorizing Traffic Control Measures with the installation of an AUTISTIC CHILD sign at 2212 NW 26th St.
- 6. Consider adopting a resolution authorizing Traffic Control Measures with the installation of Rectangular Rapid Flashing Beacon(RRFB) Pedestrian Crosswalk signs at courthouse on 6th street.
- 7. Consider endorsing the Fiscal Year 2025 Unified Planning Work Program for the Lawton Metropolitan Transportation Planning Process.
- 8. Consider approving the annual Children’s Emergency Resource Center agreement between the City of Lawton and the Marie Detty Youth and Family Services Center, Inc. for the continued establishment and operation of a program for juvenile misdemeanor offenders.
- 9. Consider approving annual agreement renewal between the City of Lawton and the Lawton CrimeStoppers, Inc.
- 10. Consider approving a memorandum of understanding with the Board of County Commissioners of Comanche County, Oklahoma, authorizing the Lawton Police Department to assist with the transportation of Comanche County Regional Juvenile Detention Center residents in the event an emergency renders the detention center unable to sustain operations and necessitates the relocation of its base of operations.
- 11. Consider approving the renewal of an annual agreement between the City of Lawton and Comanche County - County Commissioners for the purpose of providing financial assistance to the County to assist with maintaining and operating the Comanche County Regional Juvenile Detention Center.
- 12. Consider approving the Memorandum of Understanding between the City of Lawton and the Lawton Metropolitan Planning Organization for metropolitan transportation planning for Fiscal Year 2025.
- 13. Consider approving the Memorandum of Understanding between the City of Lawton and the Lawton Metropolitan Planning Organization for Congestion Mitigation and Air Quality programs and projects during Fiscal Year 2025.
- 14. Consider authorizing the Mayor and City Clerk to execute the FY-2025 Memorandum Agreement between the City of Lawton, the Oklahoma Water Resources Board and the U.S. Geological Survey and pay the city portion of cost.
- 15. Consider approving the annual Cooperative Agreement and an Agreement for Limited Funding between the City of Lawton and the Transit Trust to provide funds for the operation of a public transit system and authorize the Mayor and City Clerk to execute the same.
- 16. Consider approving a Support Agreement with Harvest Plenty House of Prayer for their Chisholm Trail Summer Camp: Riding into STEM and allocate to Harvest Plenty House of Prayer $19,860.00 from the 2019 PROPEL CIP in accordance with the intent of Resolution 23-75, Section C.5 to provide funding for youth programs, as recommended by the Youth and Family Affairs Committee.
- 17. Consider approving a Limited Support Agreement with Marie Detty Youth and Family Services, subject to approval by Marie Detty Youth and Family Services, and allocating an amount up to $100,000.00 from the 2019 PROPEL CIP under section A.4.B (2019 CIP Summer Youth Program Funding) to fund the Marie Detty Gang Intervention Program for FY 2025.
- 18. Consider approving a Reimbursement Contract with Oklahoma Department of Environmental Quality for re-imbursement of up to $30,000.00 for two household hazardous waste, pharmaceuticals, clothing and electronic waste collection events for FY25 and authorize the mayor to execute the documents.
- 19. Consider extending contract (CL23-025) Rock Hauling to G & R Enterprises, LLC of Lawton, OK as primary vendor and Spence Transportation of Elgin, OK as secondary vendor.
- 20. Consider extending contract (RFPCL23-030) Tree Trimming and Tree Maintenance to Asplundh Tree Expert, LLC for an additional year.
- 21. Consider extending contract CL22-044 Waterline Fittings and Valves to Core and Main of Owasso, OK for an additional year.
- 22. Consider approving Amendment No. 1 & Change Order No. 1 for MTZ Construction, Inc. on Engineering Project EN1707P2B - 2017 Ad Valorem Streets and Roads Program (Residential).
- 23. Consider and take action approving the plans and specifications and authorize advertisement for construction of PU2403 Map 10, located north of Cache Road, south of Rogers Lane, between 38th Street and Sheridan Road, and PU2408 Map 39, located South of Gore Boulevard, North of Lee boulevard, Between 38th Street and 52nd Street, Waterline Rehabilitation Projects.
- 24. Consider and take action approving the plans, specifications and authorize advertisement for construction of PU2309 Map 11 Phase II Waterline Rehabilitation Project, located South of Lincoln Avenue, North of Cache Road, between Sheridan Road and Ft. Sill Boulevard, to rehabilitate high maintenance water lines.
- 25. Consider approving a revocable permit for the installation of a fence in the right-of-way along SW 52nd Street for Lawton Public Schools at 5202 W Gore Blvd, Lawton, OK 73505, and authorize the Mayor and City Clerk to execute the permit.
- 26. Consider approving a revocable permit for the installation of a fence in the right-of-way along SW E Ave for Philip D. Kennedy and Anita Jo Kennedy at 1010 SW D Ave, Lawton, OK 73501, and authorize the Mayor and City Clerk to execute the permit.
- 27. Consider a request from Lawton Public Schools to waive permit fees for an LPS Staff & Family Fun Night on August 6, 2024 in Elmer Thomas Park.
- 28. Consider accepting the Dollar General Summer Reading grant of $3,000.00 from the Dollar General Literacy Foundation for summer reading activities and authorizing the City Manager to sign any reporting paperwork required.
- 29. Consider approving appointments to boards and commissions.
- 38 UNFINISHED BUSINESS
- 30. Consider adopting a resolution declaring the structures located at 401 SW Summit Avenue, to be dilapidated pursuant to Section 6-5-1 Lawton City Code, ordering the owner to abate the nuisance, authorizing summary abatement, and authorizing the City Attorney to commence legal action in District Court to abate the nuisance.
- 31. Receive a report on how the peer cities process the Small Cell Wireless Facilities in their towns and provide direction to staff as necessary.
- 32. Consider revoking the Small Cell Wireless Facility Revocable Permit for the small cell wireless facility located adjacent to 6432 NW Arrowhead Drive and take action as necessary.
- 42 BUSINESS ITEMS:
- 33. Consideration and approval of an Ordinance providing for the issuance of General Obligation Bonds, Series 2024, in the sum of $6,300,000 by the City of Lawton, Oklahoma, authorized at an election duly called and held for such purpose; prescribing form of the General Obligation Bonds, Series 2024; providing for registration thereof; approving the Official Statement pertaining to the General Obligation Bonds, Series 2024; providing for the levy of an annual tax for payment of principal and interest on the same; fixing other details of the issue; and declaring an emergency.
- 34. Receive bids for the sale of the City’s $6,300,000 General Obligation Bonds, Series 2024, and award the sale of the $6,300,000 General Obligation Bonds, Series 2024, to the lowest bidder.
- 35. Consider approving a resolution that would increase the amount of assistance in Development Financing included in the Redevelopment Agreement between the City of Lawton, the Lawton Economic Development Authority, the Lawton Fort Sill Economic Development Corporation, and Fisher59 Properties, LLC, with said increase to be based on updated cost estimates for Public Improvements associated with the project.
- 36. Consider approving an Agreement for Funding and Limited Support between the Fires Innovation Science and Technology Accelerator (FISTA) Development Trust Authority and the City of Lawton to fund the operation, management, administration, maintenance and equipping of FISTA facilities during the 2024-2025 fiscal year to encourage economic/industrial development in the City of Lawton and authorize the Mayor and City Clerk to execute the Agreement.
- 37. Receive a request for the Lawton/Fort Sill Chamber of Commerce regarding the allocation of the City’s FY 2025 Hotel/Motel Tax Fund and take action as deemed necessary.
- 38. Receive and discuss funding recommendations concerning the City’s Hotel/Motel Tax Fund, and receive direction to adopt, modify or revise said recommendations concerning City Manager’s FY 2025 hotel/motel tax recommended expenditure list.
- 39. Hold a public hearing and adopt a resolution(s) declaring the structures located at 306 NW 15th Street, 507 SW 26th Street, 508 NW 12th Street aka 506 NW 12th Street, 621 SW 26th Street, 916 SW D Avenue aka 404 SW 10th Street, 1407 SW 8th Street, 1507 NW Dearborn Avenue, 1611 NW Lawton Avenue, 1612 SW E Avenue, 1813 SW McKinley Avenue, 2025 NW 24th Street, 2409 SW C Avenue, 2609 SW E Avenue, 4628 SW G Avenue, to be dilapidated pursuant to Section 6-5-1 Lawton City Code, ordering the owner to abate the nuisance, authorizing summary abatement, and authorizing the City Attorney to commence legal action in District Court to abate the nuisance.
- 40. Consider holding a public hearing and approving an ordinance pertaining to Planning and Zoning amending Section 18-4-4-404.1, Division 18-4-1, Article 18-4, Chapter 18, Lawton City Code, 2015, by allowing legal nonconforming lots and parcels to be built on if said lot or parcel was established prior to November 10, 1964, and allowing for floor amendments if necessary.
- 41. Hold a public hearing and consider an ordinance for a rezoning request from Megan Graham for the property located at 208 NW 31st Street, Lawton, OK 73505, changing the zoning from R-1 Single-Family Dwelling District to R-2 Two-Family Dwelling District zoning classification for a duplex, and take appropriate action as deemed necessary.
- 42. Consider holding a public hearing and approving an ordinance establishing the number of parking spaces required for stadiums, sports fields and arenas, with and without fixed seating, and allowing for floor amendments if necessary.
- 43. Consider approving an Ordinance pertaining to Streets and Sidewalks by amending Sections 20-5-502 through 20-5-507, Article 20-5, Chapter 20, Lawton City Code, 2015; by changing Community Services Director to Planning Director, changing City Engineer to Public Utilities Director, changing the requirement for permission from the adjacent property owners to the applicant shall notify all property owners within 150 feet of the proposed small cell wireless facility and provide proof to the Planning Director at time of application, providing for severability, establishing an effective date and allowing for floor amendments.
- 44. Consider approving a Resolution amending Appendix A, Schedule of Fees and Charges, Lawton City Code, 2015, pertaining to Chapter 20, Streets and Sidewalks, by amending Article A-20-5, Small Cell Wireless Facility.
- 45. Discuss moving forward with the adoption of the 2018 International Code Council codes and the 2017 National Electrical Code as amended by the Oklahoma Uniform Building Code Commission (OUBCC) and direct staff as necessary.
- 46. Consider an ordinance pertaining to Administration, amending Section 2-3-13-382, and creating Section 2-3-13-385, Division 2-3-13, of Article 2-3, Chapter 2, Lawton City Code, 2015, relating to Boards, Commissions, and Committees by adjusting the number of members for the Mayor’s Commission on the Status of Women and adding language to allow for participating alternate members for the Mayor’s Commission on the Status of Women; providing for severability; providing for codification; and establishing an effective date.
- 47. Consider an ordinance pertaining to Administration, creating Section 2-3-11-372, Division 2-3-11, of Article 2-3, Chapter 2, Lawton City Code, 2015, relating to Boards, Commissions, and Committees by adding language to allow for Participating Alternate members for the Capital Improvement Program Advisory Committee; providing for severability; providing for codification, and establishing an effective date.
- 48. Discuss and take necessary action on changing the time of regularly scheduled City Council meetings to 6:00 PM, including establishing an effective date for this change, and directing staff to post any required notices.
- 59 STAFF REPORTS:
- 49. Provide City Council with an update on the FY 2024 Audit Process.
- 50. Receive a report from staff regarding the status of the program to install signage regarding panhandling and take action as deemed necessary.
- 62 EXECUTIVE SESSION ITEMS:
- 51. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss a pending action with Oklahoma Department of Environmental Quality concerning a Notice of Violation issued by ODEQ to the City on February 14, 2024, in relation to the City of Lawton Municipal Solid Waste Landfill and the FY 2022 and FY 2023 financial assurance mechanism update, local government test, not having been submitted by December 31, 2022 and December 31, 2023, respectively, and , if necessary, take appropriate action in open session.
