  2. 2 "Official action can be taken only on items which appear on the agenda. The Council may adopt, approve, ratify, deny, defer, recommend, or continue any agenda item. The Council may also propose and enact floor amendments to any matter presented before them. When more information is needed to act on an item, the Council may refer the matter to the City Manager or the City Attorney. The Council may also refer items to standing committees of the Council or a board, commission, or authority for additional study. Under certain circumstances, items are deferred to a specific later date or stricken from the agenda entirely."

  7. 7 AUDIENCE PARTICIPATION: Lawton citizens who have completed a Request to Speak Form and wish to address business not listed on the agenda may step forward at this time. To ensure compliance with the Oklahoma Open Meeting Act, the Mayor and Council will receive comments but will NOT engage in direct responses. However, they may refer matters to the appropriate department or individual for further consideration and follow-up action. To participate, speakers must submit a Request to Speak Form to the City Clerk and reside within the Lawton city limits. Each speaker is allotted 3 minutes, with a maximum of 9 minutes per topic, and Audience Participation is limited to 30 minutes total. All participants are expected to follow the Rules of Decorum as outlined in Council Policy 1-6.

  9. 1. Consider approving two (2) damage claims (recommended for approval) and resolutions authorizing payments for Cherie Richey in the amount of $1,285.20, and Nancy Seres on behalf of Pat Taylor in the amount of $150.00. 24-2047
  10. 2. Consider the following two (2) damage claims recommended for denial: Patriot Homes of Lawton in the amount of $336.25, and Nancy Seres in the amount of $150.00. 24-2048
  11. 3. Consider approving a resolution amending the City of Lawton FY25 Budget, as amended, by appropriating $2,500 from the AmeriCorps RSVP Grant Award to the RSVP Travel and Training fund. 24-2049
  12. 4. Consider approving a Change Order 1 on Project PR2309-Elmer Thomas Park Aquatic Center to reduce the contract amount by $705,049.00, based on the Value Engineering review. 24-2007
  13. 5. Consider adopting a resolution authorizing Traffic Control Measures with the installation of a Speed Table at the location of 1705 NW Great Plains Blvd. 24-2004

  15. 7. Consider approving an assessment waiver for a mowing and clearing lien in the amount of $1,291.86 on the property located at Block 63, Lots 17-32, Lawton Heights Addition (1301 NW Andrews Avenue). 24-2005
  16. 8. Consider approving $265,154.95 to be the actual cost of the dismantling and removal of the dilapidated building located at Block 63, Lots 17-32, Lawton Heights Addition (1301 NW Andrews Avenue) and ratify certification of said amount to the county treasurer. 24-2006

Consider determining the actual costs of the dismantling and removal of dilapidated buildings and other expenses that may be necessary in conjunction with same by approving invoices for demolition of properties as required by State Statue 11-22-112.4 for properties located at 2417 SW J Avenue, 1901 SW N H Jones Avenue, 1814 SW A Avenue, 1214 SW A Avenue and 809 SW 4th Street. 24-2039
  18. 10. Consider and take action in approving Amendment Number 9 to the Master Services Agreement with Jacobs Engineering Group, INC, in the amount not to exceed $336,584.00 for professional engineering services for Gondola Dam Improvements project PU2407. 24-2001

Consider approving a First Amendment Agreement between the Lawton Youth Sports Trust Authority and the City of Lawton for FY 24-25, contingent upon the Lawton Youth Sports Trust Authority also approving the agreement, providing $345,000.00 from the General Fund for program support and $700,000.00 from the 2019 Capital Improvement Fund for the design and/or purchase or lease of property to be the site of a sports complex. 24-2060

Consider and take action approving Change Order 1 for the Water SCADA Improvements Project PU2201 as constructed by Control Panels USA, Inc increasing the contract by $123,392.96, a 2% increase of the original contract amount, for a total contract amount of $6,235,882.92. Change order #1 is the replacement of fiberoptic cable from the Southeast Water Treatment Plant to the Wastewater Treatment Plant. 24-2046

Consider approving an Agreement for Limited Support between the Museum of the Great Plains Trust Authority and the City of Lawton to fund the continued operation of the Museum, contingent upon the Museum of the Great Plains Trust Authority approving the Agreement, and authorize the Mayor and City Clerk to execute the Agreement. 24-2030

  32. 23. Receive presentations from both the Parks and Recreation Department regarding Olson Park and the Salvation Army regarding their facility, discuss either hosting a location for unhoused individuals to shelter in the City of Lawton, and take appropriate action as deemed necessary. 24-2059

Consider an ordinance pertaining to offenses and crimes by creating Section 16-3-1-326, Division 16-3-1, Article 16-3, Chapter 16, Lawton City Code, 2015; by adding language to define camping and public property, adding language to penalize unauthorized camping in non-designated areas, adding language to create a misdemeanor and penalty provision, providing for severability, providing for codification, and declaring an emergency. 24-2056

  35. 25. Consider receiving a presentation from the Mt. Scott Masonic Lodge #540 and approving an MOU regarding the placement of a retired flag drop-off box at City Hall. 24-2064

Consider approving a resolution declaring the intent to consider approval of a proposed major amendment to the Skills Training, Education, Development and Investment (“STEDI”) Project Plan and creation of tax increment districts under the Local Development Act; directing preparation of a proposed amendment to the STEDI Project Plan; reconvening the review committee; directing the review committee to make findings as to eligibility and financial impact, if any, on taxing jurisdictions and business activities within the proposed increment districts; directing the review committee to make recommendation with respect to the proposed amendment to the STEDI Project Plan; directing the planning commission to determine conformance of the proposed amended project plan with the Lawton Comprehensive Plan and to make a recommendation with respect to the proposed amendment to the STEDI Project Plan. 24-2055

Consider holding a public hearing and approving an Ordinance pertaining to Planning and Zoning amending Section 18-1-1-114, Division 18-1-1, Article 18-1, Chapter 18, Lawton City Code, 2015 by establishing the notice requirements for medical and nonmedical detoxification facilities in accordance with Oklahoma State Statue, providing for severability, and establishing an effective date. 24-1997

Consider holding a public hearing and approving an Ordinance pertaining to Planning and Zoning amending Section 18-1-1-110, Division 18-1-1, Article 18-1, Chapter 18, Lawton City Code, 2015 by declaring that temporary zoning classifications established prior to January 1, 2007 will be grandfathered as permanent zoning classifications as of December 1, 2024 and establish that any new annexed property will receive a zoning recommendation from the City Planning Commission as part of the annexation process; providing for severability, establishing an effective date and allowing for floor amendments if necessary. 24-2002

Consider approving an ordinance pertaining to streets and sidewalks relating to authorized work on streets by city utilities, contractors-requirements-notice, amending Sections 20-1-102, Article 20-1, Chapter 20, Lawton City Code, 2015 by requiring any pre-planned work on city streets to provide greater notice to affected residents and entities, changing responsibility to the city Public Works Department, providing for severability and declaring an effective date. 24-2044

Consider approving an ordinance pertaining to streets and sidewalks relating to the general requirements of a communication or pipeline system permit, amending Section 20-4-405, Article 20-4, Chapter 20, Lawton City Code, 2015, by requiring any pre-planned work on city streets to provide greater notice to affected residents and entities, providing for severability and establishing an effective date. 24-2045
  41. 31. Consider authorizing staff to apply for the Energy Efficiency and Conservation Block Grant (EECBG) program in the amount of $146,710 for the purchase of energy efficient equipment. 24-2066

Consider an ordinance pertaining to General Provisions amending Section 1-1-120, Division 1-1, Chapter 1, Lawton City Code, 2015, related to City insignia, seals and logos by adding language to designate the “I Love Lawton/Fort Sill” symbol as the official emblem of the City of Lawton, providing for severability, and establishing an effective date. 24-2022

  50. 50 EXECUTIVE SESSION ITEMS:

Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss an action relating to litigation against Settling Defendants and other defendants, which actions are currently pending in the multi-district litigation styled, In Re: Aqueous Film-Forming Foams Products Liability Litigation, MDL No. 2:18-mn-2873 (D.S.C.) (the “MDL”) and Case No. 2:23-cv-03230, to resolve claims relating to PFAS contamination, and if necessary, take action in open session. 24-1961

Pursuant to 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the pending action in the United States District Court for the Western District of Oklahoma titled Joseph Gonzalez, as the Personal Representative of the Estate of Tshante Gonzalez, Deceased v. City of Lawton, et al, Case Number CIV-24-1022-D, and if necessary, take appropriate action in open session. 24-2061
  53. 41. Pursuant to Section 307B.1, Title 25, Oklahoma Statutes, consider convening in executive session to review the employment of John Ratliff as City Manager, and in open session take other action as necessary. 24-1979

  55. 55 The City of Lawton encourages participation from all of its citizens. If participation at any public meeting is not possible due to a disability, notification to the City Clerk at (580) 581-3305 at least 48 hours prior to the scheduled meeting is encouraged to make the necessary accommodations. The City may waive the 48 hour rule if interpreters for the deaf (signing) is not the necessary accommodation."
