Chairman McHughes stated that from a non-attorney perspective, there does not appear to be clear statutory authorization, and the issue falls into a gray area. However, support is being given at this time based on the District Attorney’s favorable opinion. Future support cannot be guaranteed. Legislative approval is needed because the authority is not clearly defined. While it is recognized as a strong public safety measure, it should be formally codified into law. It is recommended that the Sheriff’s Office work with the OSA or the District Attorney’s office to file a bill to ensure this authority is clearly established in statute. 26-0059 postponed Pass ▶ jump to 18:59
