  12. 11 The Levine Act (California Government Code Section 84308) prohibits, in certain cases, campaign contributions to members of the Board of Supervisors by those who have proceedings (e.g., applications for land use and other entitlements, contracts, etc.) pending before the Board of Supervisors and by those who may have an interest in such proceedings (including those acting as agents for applicants or potential contractors). Moreover, the Levine Act may require disclosure of contributions by such individuals. The law is complex and this brief description is not legal advice. Adopt a resolution amending and restating Resolution No. 080959, for the purpose of: A) Authorizing a conditional allocation of $9,000,000 in general fund monies or other available funds to assist in the development of an 88 unit, 100% affordable, deed restricted, rental housing project at 320 Sheridan Dr. in Menlo Park (the configuration of which does not preclude accommodating a secondary egress point from the site parking lot to a publicly accessible road, if such is later approved), including preference criteria for thirty-five (35) units for County and other local public employees to the extent permitted by applicable law (the “Project”), which allocation shall be expressly contingent upon a confirmed award of either funding for the Project under the California Housing Finance Agency’s (CalHFA’s) Mixed Income Program (MIP) or allocation of 4% state and federal tax credits for the Project by the California Tax Credit Allocation Committee (CTCAC) not later than July 30, 2025; and B) Authorizing the County Executive, or designee(s), to execute a letter to CalHFA, substantially in the form of Attachment A, specifying the County’s funding commitment for the Project as contingent upon a confirmed award of either MIP funding or allocation of 4% state and federal tax credits for the Project by CTCAC not later than July 30, 2025; and C) Authorizing, if the Project is awarded MIP funding or an allocation of 4% state and federal tax credits not later than July 30, 2025, the Director of the Department of Housing, or designee(s), acting in consultation with the County Attorney and the approval of the County Executive, to negotiate and execute a loan agreement with Alliant Communities for the construction and development of the Project in an amount not to exceed $9,000,000, and associated security instruments and regulatory agreement restricting the use of the property for affordable housing; and D) Authorizing, if the Project is awarded MIP funding or an allocation of 4% state and federal tax credits not later than July 30, 2025, the Director of the Department of Housing, or designee(s), acting in consultation with the County Attorney and the approval of the County Executive, to negotiate and execute any and all agreements, documents, certificates and amendments as may be necessary and advisable and within the scope of funding authorized by the Board for the Project to effectuate the purposes of this Resolution. 25-1050 approved Pass

Measure K: Adopt a resolution: A) Authorizing and directing the Director of the San Mateo County Department of Housing (“DOH”), or designee, to negotiate and execute, in consultation with the County Attorney, an Exclusive Negotiating Agreement with MidPen Housing, or an affiliate entity, to afford the parties sufficient time not to exceed one year unless an extension is necessary and advisable in the Director’s discretion, to negotiate the terms of both a Development Agreement and an Agreement to provide site control of property located at 626, 640, and 648 Walnut Street in the City of San Carlos (the “Property”) with MidPen Housing, or an affiliate entity, for the purpose of developing and operating an affordable housing development on the Property for low-, very low- and extremely-low income households, including persons experiencing or at risk of homelessness and local public employees, to the extent and in a manner allowable by law; and B) Authorizing and directing the Director of DOH, or designee, in conjunction with MidPen Housing, to submit, or cause to be submitted, to the City of San Carlos, all necessary entitlement application documents required to ensure development at the Property proceeds in accordance with state law; and C) Authorizing and directing the Director of DOH, or designee, in consultation with the County Attorney, to negotiate and enter into a Development Agreement with MidPen Housing, or an affiliate entity, regarding design, development, construction, ownership, and management of the Property and the provision of on-site resident services at the Property; and D) Authorizing and directing the Director of DOH, or designee, to enter into necessary agreements to provide site control of the Property, through a ground lease with at least a 55 year term, or another instrument agreeable to both DOH and MidPen Housing, subject to County Attorney review and approval, with MidPen Housing or an affiliate entity to facilitate MidPen Housing, or its affiliate entity developing, owning and operating an affordable housing development on the Property for low-, very low- and extremely low-income households, including persons experiencing or at risk of homelessness and local public employees, to the extent and in a manner allowable by law; and E) Authorizing and directing the Director of DOH to enter into an Initial Predevelopment Loan Agreement in an amount not to exceed $250,000 to MidPen Housing, or an affiliate entity, for early predevelopment activities, on terms and subject to an agreement in a form approved by the DOH Director and the County Attorney, from Measure K (AHF) funds, or other available funding sources, with no increase to Net County Cost; and F) Authorizing the Director of DOH, or designee, acting in consultation with the County Attorney, to negotiate and execute any and all agreements, documents, certificates, extensions and amendments as may be necessary to effectuate the purposes of this resolution. 25-1051 approved Pass
