Resolution to Amend the FY 2023-24 Capital Improvement Program (CIP) Budget by Unappropriating American Rescue Plan (ARP) Funding and Appropriating Measure A Funding to Fund Five Park Playground Projects It is recommended that the City Council adopt the following resolution: RESOLUTION NO. 2024-24 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POMONA, CALIFORNIA, TO AMEND THE FY 2023-24 CAPITAL IMPROVEMENT PROGRAM (CIP) BUDGET BY UNAPPROPRIATING $434,000 OF CORONAVIRUS STATE AND LOCAL FISCAL RECOVERY AMERICAN RESCUE PLAN FUNDING FROM “NEW PLAYGROUND AT WASHINGTON PARK BASEBALL FIELDS,” PROJECT NO. 428-2590-XXXXX-71094, “COUNTRY CROSSING PARK PLAYGROUND RESURFACING AND PLAY EQUIPMENT,” PROJECT NO. 428-2590-XXXXX-71089, AND “DISTRICT 4 - JAYCEE PARK PLAYGROUND UPGRADE,” PROJECT NO. 428-2590-XXXXX-71090; FUNDING A PREVIOUSLY UNFUNDED PROJECT, “MARTIN LUTHER KING, JR. Award a Contract to Oppenheimer National for the Installation of Drinking Fountains It is recommended that the City Council take the following actions: 1) Approve the project, as described below, as being categorically exempt from CEQA pursuant to Section 15301; 2) Award a construction contract to Oppenheimer National for “Hydration Stations Upgrades,” Project No. 528-2590-XXXXX-71073 to include Base Bid and Additive Alternate for the installation of drinking fountains in the amount of $198,248; and, 3) Authorize the City Manager, or designee, to execute the construction contract and all related documents with Oppenheimer National on behalf of the City and any subsequent documents or amendments, subject to approval by the City Attorney. 24-1146

Approval to Authorize Amendment of Agreement with God’s Pantry; and Execution of an Agreement with the Institute of Ecological Civilization Relating to the Implementation of the California Violence Intervention and Prevention Grant (CalVIP) It is recommended that the City Council take the following actions: 1) Amend the approved two-and-a-half year agreement with God’s Pantry in the amount not to exceed $860,000 to hire a Full-Time Equivalent (FTE) Violence Intervention Manager to provide supervision for Neighborhood Change Agents (NCA’s); and oversee the implementation of the Peacemaker Fellowship program. 2) Approve a sole source extension for CalVIP grant coordinating and reporting services to the Institute of Ecological Civilization (EcoCiv) not to exceed $87,750. 3) Authorize the City Manager, or designee, to execute the agreement and any extensions, subsequent changes, or amendments thereto, on behalf of the City, subject to review and approval as to form by the City Attorney. 24-1147

Award a Sole Source Agreement to Ken Grody Ford for Vehicle Purchases in the Amount of $120,000 for FY 2023-24 In Support of a Pilot Park Ambassador Program It is recommended that the City Council approve a purchase of three 2024 Ford Maverick trucks from Ken Grody Ford in amount not to exceed $120,000. 24-1149

Finding of Public Benefit to the Community at Large-Recommended Expenditure(s) and Recap of Expended Funds It is recommended that the City Council take the following actions: 1) Approve the expenditure(s) recommended and make the finding that the community at large will receive a public benefit from the expenditure of funds for the recommended item(s); and 2) Receive and file the recap of final amounts. 24-1074

Impact Analysis Report on the Possible Effects of the Proposed Initiative Petition to Amend the City Charter to Require 10% of Annual unrestricted General Fund Revenues be Transferred to a new Special Fund restrictive to funding no cost services to Children and Youth, with a minimum 65% of such monies going to non-profit organizations through a competitive grant application and award process overseen by an appointed Citizen Board It is recommended the City Council: 1) Receive and file the Impact Analysis Report on the possible effects of the proposed “Pomona Kids First” initiative petition to amend the Pomona City Charter as described herein; 2) Based upon the Impact Analysis Report, Submit the Measure to the voters at the “next regular municipal election” occurring at least 88 days later. Under Elections Code section 348, a “[R]egular election is an election, the specific time for the holding of which is prescribed by law.” The next being the City’s upcoming General Municipal Election on November 5, 2024. 24-1130

Selection of a Development Team for the Downtown Development Opportunity Site and Direction to Prepare an Exclusive Negotiation Agreement It is recommended that the City Council take the following action: Select the Development Team of Village Partners/Arteco Partners/National CORE (Development Team) to move forward in the Downtown Development Opportunity Site Process and direct staff to bring back an Exclusive Negotiation Agreement (ENA) for Approval with the Selected Development Team. 24-1131
