10. 7 Mike Hembree, Vice Chair of the Charter Review Advisory Committee, gave a presentation. Overview of Presentation Laws that affect Charter Topics considered by the CRAC Recommended Charter Amendments Possible Timeline Direction from Council on next steps Laws that Affect Charter Texas Constitution – Article XI, Section 5 • A City Charter may not be altered, amended or repealed more often than every two years. The City Charter – Article X, Section 28 • Not less than once every two years following an election to amend this Charter and each two years thereafter, the City Council shall conduct a review to determine if amendments or other revisions to the Charter are necessary or in the best interest of the City. Texas Local Government Code – Chapter 9 • Election must occur on the first authorized uniform election date, the next municipal general election, or presidential election • Election must occur on or after the 30th day after election ordinance • The ballot amendments must be worded in such a way so that a voter can either approve or disapprove
11. 8 This is to certify that the above Notice of Meeting was posted on the bulletin board of City Hall of the City of League City, Texas, on or before the 10th day of May, 2024 prior to 12:30 p.m. as well as the City's public internet webpage, www.leaguecitytx.gov and was posted in accordance with the Texas Open Meetings Act, Chapter 551, Government Code.
12. 8 • Each proposed amendment may not contain more than one subject • Any voter-approved charter amendment does not take effect until the City Council formally declares the amendments adopted by a subsequent ordinance • Any charter amendments must be filed with the Secretary of State Topics Considered by the CRAC • Recall Procedure • Council Vacancy Procedure • Total number of Council Seats • Form of Government • Newspaper publications • Bond Election Language • Housekeeping edits • Single-Member Districts • Partisan Elections • Mayor appointment authority • Abstention Vote Explanations • City Attorney Appointment Recommended Changes • Article II, Section 17 (Appointive Officers) – City Secretary Bond Amount: We recommend that the specific bond amount for the City Secretary be deleted. • Article II, Section 17 (Appointive Officers) – Mayor Appointment Authority: We recommend that the charter language be changed to allow other Councilmembers to make nominations for appointments for the City’s boards, commissions and agencies, not just the Mayor. • Article II, Section 18 (Bond of Officers): We recommend that the specific bond amount for Councilmembers be deleted from the Charter. • Article III, Section 1 (General Election): We recommend that the references to the 2013 and 2015 election dates be deleted from the Charter. • Article IV, Section 3 (Requirements of petition for initiative or referendum): We recommend the required signatures for a petition/referendum be reduced from 20% of registered voters to 10% of those who voted in the last general election, with a required 2,000 minimum signatures required. • Article X, Section 7 (Streets and Subdivisions): We recommend that Harris County be added to account for the parts of League City located in Harris County.
