  2. 2 "Official action can be taken only on items which appear on the agenda. The Council may adopt, approve, ratify, deny, defer, recommend, or continue any agenda item. The Council may also propose and enact floor amendments to any matter presented before them. When more information is needed to act on an item, the Council may refer the matter to the City Manager or the City Attorney. The Council may also refer items to standing committees of the Council or a board, commission, or authority for additional study. Under certain circumstances, items are deferred to a specific later date or stricken from the agenda entirely."

  4. 4 PRESENTATION: True North Star Award Introduction of New Employees: Julia Mantzke, City Council Relations Liaison and Shawna McCune, Veterinarian.
  5. 5 REPORTS: MAYOR/CITY COUNCIL
  6. 6 AUDIENCE PARTICIPATION: Lawton citizens having an item of business to present to the City Council that does not appear on the agenda please come forward at this time. The Mayor and Council will receive comments from audience members. Council may recommend to the individual or group as to what action they should take, i.e., refer the situation to a particular department or person at the city offices. In order to participate in Audience Participation, each speaker must submit a Request to Speak Form to the City Clerk and must reside within the city limits of Lawton. Each speaker will have a 3-minute time limit, each topic will have a 9-minute time limit, and Audience Participation will be limited to 30-minutes in total. Each participant is required to adhere to the Rules of Decorum outlined in Council Policy 1-6.

  8. 1. Consider approving two (2) damage claims (recommended for approval) and resolutions authorizing payments for Donna Ahlborn in the amount of $2,000.00, and Nakisha Horne in the amount of $4,202.98. 24-1813
  9. 2. Consider the following damage claim recommended for denial: Andrea Flowers in the amount of $102.85. 24-1814
  10. 3. Consider adopting a resolution approving the joint petition settlement in the amount of $12,200.00 and making payment in the workers’ compensation claim of John Robinson. 24-1822
  11. 4. Consider adopting a resolution ratifying the action of the Deputy City Attorney and the City Manager in making payment on the judgment in the amount of $34,650.00, in the Workers' Compensation case of Thad R. Hulbert in the Oklahoma Workers' Compensation Commission, Case No. CM3-2022-05003K. 24-1823
  12. 5. Consider approving a resolution amending Resolution 24-107 by updating language and establishing an annual funding allocation for Hotel/Motel Tax Collections received by the City of Lawton. 24-1776
  13. 6. Contingent upon the passage of the proposed Hotel/Motel Resolution, consider approving an Agreement between the Lawton Fort Sill Chamber of Commerce and the City of Lawton to fund activities by the Chamber designed to encourage, promote and foster tourism, including elements of economic development related thereto in the City of Lawton, and authorize the Mayor and City Clerk to execute the Agreement. 24-1804
  14. 7. Consider adopting a resolution authorizing Traffic Control Measures with the installation of a Speed Table at the location of the 1600 block of SW 16th Street. 24-1797
  15. 8. Consider approving a resolution casting a vote for Trustee of the Oklahoma Municipal Retirement Fund (OkMRF) in support of Robert B. Johnston, to fill the expiring term of at-large trustee representing the entire membership. 24-1831
  16. 9. Consider approving renewal of the master services retainer agreement for professional engineering services to WSB for the purpose of providing full engineering services for the City of Lawton and authorize the Mayor and City Clerk to execute the contract. 24-1609
  17. 10. Consider approving the networking upgrade agreement with Vested Networks and RelevantTec for data center networking equipment upgrade, installation, license and maintenance support. 24-1758
  18. 11. Consider approving a contract with Greystone Construction Company for salt and sand storage building in the amount not to exceed $360,000.00. 24-1786
  19. 12. Consider extending contract RFPCL24-004 for Physical Damage Coverage (Select Vehicles & Heavy Equipment) to North American Insurance Agency of Lawton LLC dba INSURICA of Lawton underwritten by OMAG 24-1794
  20. 13. Consider approving the Contribution-In-Aid-Of-Construction (CIAC) Agreements with AEP/PSO and adopting Street Light Resolution No. 509 to authorize installation/removal of a street light at the locations listed in the Resolution. 24-1798
  21. 14. Consider renewing a professional services agreement with FORVIS-MAZARS, LLP for the City's annual auditing services for FY 2022-2023, including the City's required single audit of expenditures from federal financial awards. 24-1816
  22. 15. Consider renewing a professional services agreement with Crawford & Associates, PC for the City's annual financial statements and general accounting and advisory assistance services for FY2023 and FY2024. 24-1836
  23. 16. Consider approving offsite improvement construction plans for an extension to SW Gilbert Gibson Rd, water line, and sanitary sewer to serve Fisher 59 and future development within the Airport Industrial area, subject to the conditions listed. 24-1824
  24. 17. Consider ratifying the City Manager’s decision to enter into an agreement with Deckard Technologies. 24-1825
  25. 18. Consider directing the City Manager to have a crosswalk and two (2) pedestrian signs installed at the intersection of NW 53rd Street and NW Meadowbrook Avenue. 24-1839
  26. 19. Consider approving Resolution 24-_____, allocating and directing the STEM funding generated from the TIF Districts included within STEDI Project Plan. 24-1846

  29. 21. Continue discussing revoking the Small Cell Wireless Facility Revocable Permit for the facility constructed at or near 7990 NW Micklegate Boulevard also known as CRAN 003E and take action as deemed necessary. 24-1566
  30. 22. Receive a presentation on proposed infrastructure improvements for City of Lawton Lakes and take appropriate action as deemed necessary. 24-1809
  31. 31 BUSINESS ITEMS:
  32. 23. Consideration and action upon Resolution of the City of Lawton, Oklahoma (the “City”) authorizing and approving the incurring of indebtedness by the trustees of the Lawton Industrial Development Authority (herein the “Authority”) to be accomplished by the issuance of its Sales Tax Revenue Note, Series 2024C or other evidences of indebtedness in one or more series designations on a tax-exempt or taxable basis, at a premium or discount, in the aggregate principal par amount of not to exceed Forty Million Dollars ($40,000,000) (herein the “Note”) for the purpose of financing all or a portion of the cost of the acquisition, construction, equipping, renovating, and improving of certain public infrastructure and capital improvement projects for the benefit of the City; and pay costs of issuance related thereto; providing that the organizational document creating the Authority is subject to the provisions of the indenture authorizing the issuance of said Note; approving the award of the sale of said Note on a negotiated basis, approving the waiver of competitive bidding with respect to the sale of said Note; and approving the proceedings of the Authority pertaining to the sale of said Note; approving and authorizing a Sales Tax Agreement (the “Sales Tax Agreement”) by and between the City and the Authority pertaining to the year-to-year pledge of certain sales tax revenues; and all matters related thereto, including execution of all related documents thereto. 24-1827

  34. 25. Consider authorizing staff to apply for the Oklahoma Department of Environmental Quality On-Road2 Grant funded by the Volkswagen Diesel Emissions Environmental Mitigation Trust 24-1793

Consider approving an ordinance pertaining to nuisances and health by amending Section 15-2-206, Article 15-2, Chapter 15, Nuisances and Health, Lawton City Code 2015, by adding language to allow for abatement of refuse at the curb and allowing the placement of lien against properties, providing for severability and declaring an emergency. 24-1810
  36. 27. Discuss the persistent overgrowth of tall grass and weeds around railroad tracks and consider directing the City Attorney to issue a formal demand letter to the property owners to immediately abate this nuisance. 24-1834
  37. 28. Consider approving a Professional Services Agreement in an amount up to $40,000.00 with Dr. Christopher M. Hill, University of Oklahoma Sociology Department, to conduct research regarding crime and safety in Lawton, and take action as deemed necessary. 24-1833
  38. 29. Consider approving twenty-four additional roads for milling and overlaying under Mayor Booker's "10 Wins for the Citizens" initiative, to be named "24 Roads for Even More in '24." 24-1847
  39. 39 STAFF REPORTS:
  40. 30. Provide City Council with an update on the FY 2024 Audit Process.
  41. 31. Receive an informational brief on the activities of the Highland Cemetery, including information about digitizing records and tying plots to GIS data. 24-1811
  42. 42 EXECUTIVE SESSION ITEMS:
  43. 32. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the pending damage claim of Angel Owens and, if necessary, take appropriate action in open session. 24-1815
  44. 33. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss an action relating to litigation against the manufacturers and distributors of opioids in an effort to hold them accountable for their marketing practices alleged to have caused damages suffered by municipalities, specifically, the City’s pending litigation as part of In Re: National Prescription Opiate Litigation MDL No. 2804, and if necessary, take action in open session. 24-1817
  45. 34. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss a pending action with Oklahoma Department of Environmental Quality concerning a Notice of Violation issued by ODEQ to the City on July 30, 2024, in relation to the City of Lawton Wastewater Treatment Facility citizen complaint No. 186676, and, if necessary, take appropriate action in open session. 24-1819
  46. 35. Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss a possible pending action with Great Plains Improvement Foundation concerning a HOME Program Finding Report received from U.S. Department of Housing and Urban Development to the City of Lawton on July 26, 2024, and if necessary, take appropriate action in open session. 24-1842
  47. 36. Pursuant to Section 307B.1, Title 25, Oklahoma Statutes, consider convening in executive session to review the employment of Donalynn Blazek-Scherler as City Clerk, and in open session take other action as necessary. 24-1837
  48. 48 ADJOURNMENT
  49. 49 The City of Lawton encourages participation from all of its citizens. If participation at any public meeting is not possible due to a disability, notification to the City Clerk at (580) 581-3305 at least 48 hours prior to the scheduled meeting is encouraged to make the necessary accommodations. The City may waive the 48 hour rule if interpreters for the deaf (signing) is not the necessary accommodation."
