  2. 2 "Official action can be taken only on items which appear on the agenda. The Council may adopt, approve, ratify, deny, defer, recommend, or continue any agenda item. The Council may also propose and enact floor amendments to any matter presented before them. When more information is needed to act on an item, the Council may refer the matter to the City Manager or the City Attorney. The Council may also refer items to standing committees of the Council or a board, commission, or authority for additional study. Under certain circumstances, items are deferred to a specific later date or stricken from the agenda entirely."

  5. 1. Receive the annual presentation from the Lawton Enhancement Trust Authority. 24-1850
  6. 6 REPORTS: MAYOR/CITY COUNCIL
  7. 7 AUDIENCE PARTICIPATION: Lawton citizens having an item of business to present to the City Council that does not appear on the agenda please come forward at this time. The Mayor and Council will receive comments from audience members. Council may recommend to the individual or group as to what action they should take, i.e., refer the situation to a particular department or person at the city offices. In order to participate in Audience Participation, each speaker must submit a Request to Speak Form to the City Clerk and must reside within the city limits of Lawton. Each speaker will have a 3-minute time limit, each topic will have a 9-minute time limit, and Audience Participation will be limited to 30-minutes in total. Each participant is required to adhere to the Rules of Decorum outlined in Council Policy 1-6.

  9. 2. Consider approving one (1) damage claim (recommended for approval) and resolution authorizing payment for Victor Fredricks in the amount of $3,008.44. 24-1910
  10. 3. Consider the following damage claims recommended for denial: Reginald Fisher and Kelea Fisher in the amount of $3,928.55, and Gloria Flores in the amount of $620.00. 24-1885
  11. 4. Consider approving renewal of the master services retainer agreement for professional engineering services to WSB for the purpose of providing full engineering services for the City of Lawton and authorize the Mayor and City Clerk to execute the contract. 24-1609
  12. 5. Consider waiving fees for a Sound Amplifying Permit and an Event Permit- Public Major totaling $125 in support of the Park-o-Treat community Halloween event to be held on October 19, 2024 and direct staff to issue a refund for fees already paid. 24-1853
  13. 6. Consider approving an agreement between the Lawton Heritage Association and the City of Lawton, subject to the Lawton Heritage Association also approving the agreement, to fund activities by the Association designed to encourage, promote and foster tourism and economic development in the City, and authorize the Mayor and City Clerk to execute the agreement. 24-1873

Consider approving an agreement between the Lawton Community Theatre, Inc. and the City of Lawton, subject to the Lawton Community Theatre, Inc. also approving the agreement, to fund activities by the Theatre designed to encourage, promote and foster tourism and economic development in the City, and authorize the Mayor and the City Clerk to execute the agreement. 24-1874

Consider approving an agreement between the Lawton Philharmonic Society, Inc. and the City of Lawton, subject to the Lawton Philharmonic Society, Inc. also approving the agreement, to fund activities by the Society designed to encourage, promote and foster tourism and economic development in the City, and authorize the Mayor and City Clerk to execute the agreement. 24-1875

Consider approving an agreement between the Museum of the Great Plains Authority and the City of Lawton, subject to Museum of the Great Plains Authority also approving the agreement, to fund activities by the Authority designed to encourage, promote and foster tourism and economic development in the City, and authorize the Mayor and City Clerk to execute the agreement. 24-1876

Consider approving an agreement between the Lawton Farmers Market Institute and the City of Lawton, subject to the Lawton Farmers Market Institute also approving the agreement, to fund activities by the Market designed to encourage, promote and foster tourism and economic development in the City, and authorize the Mayor and City Clerk to execute the agreement. 24-1877

Consider approving an agreement between the Lawton Fort Sill City-Wide Juneteenth, Inc. and the City of Lawton, subject to the Lawton Fort Sill City-Wide Juneteenth, Inc. also approving the agreement, to fund activities by Juneteenth designed to encourage, promote and foster tourism and economic development in the City, and authorize the Mayor and the City Clerk to execute the agreement. 24-1878

Consider approving a partnership agreement between the McMahon Auditorium Authority and the City of Lawton, subject to the McMahon Auditorium Authority also approving the agreement and budget, to promote tourism and make renovations and repairs to Arts and Humanities related buildings. 24-1892

  24. 17. Consider approving a contract with Greystone Construction Company for salt and sand storage building in the amount not to exceed $360,000.00. 24-1893
  25. 18. Consider awarding a contract in the amount of $6,425,000.00 to Stampede Utility Construction LLC, for the construction of Map 39 Waterline Replacement Project PU2408 located south of Gore Blvd. between SW 38th and 52nd Street to rehabilitate waterline services. 24-1897
  26. 19. Consider approving Amendment No. 1 to the Standard Form of Agreement between the City of Lawton and GH2 Architects, LLC. to provide professional architectural and engineering services to design selected schematic design plan on Project PR2310 East Side Park and Lee West Park Improvements. 24-1902
  27. 20. Consider awarding a contract in the amount of $7,649,317.00 to Southwest Water Works, LLC, for the construction of Map 11 Phase II Waterline Replacement Project PU2313, located South of Lincoln Avenue, North of Cache Road, between Sheridan Road and Ft. Sill Boulevard, to rehabilitate high maintenance waterlines. 24-1904
  28. 21. Consider awarding contract RFPCL25-008 ATM Services for Finance to Oklahoma ATM for these locations: City Hall (1), Lakes HQ (1) and Public Safety Facility locations (2). 24-1906
  29. 22. Consider approving Amendment No. 1 to the Standard Form of Agreement between the City of Lawton and GH2 Architects, LLC to provide professional architectural and engineering services to design selected schematic design plan on Project EN2304 Animal Welfare Building in the amount $468,700.00. 24-1908
  30. 23. Consider approving three lease financing proposals for the purchase of three fire department apparatus as designated in the City of Lawton Annual Budget for Fiscal Year 2024-2025 and authorizing the Mayor and/or City Manager to sign these proposals from Lease 2, Inc. and subsequent purchase agreements from Heartland Fire Trucks representing The Sutphen Corporation for three fire department apparatus: 1 aerial ladder unit (Sutphen SPH100 Aerial), 1 pumper truck (Sutphen Engine), and 1 medical response unit (Sutphen Rescue). 24-1909

Consider approving a professional services agreement with the Center for Economic Development Law, to provide the City with legal advice, consultation and representation in the area of economic development and other specific matters, as requested, and authorize the Mayor to execute the Agreement. 24-1914

Consider approving a revocable permit for parking and maneuvering and for the construction of a concrete patio with railing upon utility easements on a tract of land owned by the Busse 3, LLC and addressed as 1415-1423 NW 67th, Lawton, Oklahoma 73505, and authorize the Mayor and City Clerk to execute the permit. 24-1918
  33. 26. Consider accepting a $ 270,000.00 Federal Aviation Administration (FAA) Grant that will be used to fund a Preliminary Engineering Report (PER) to relocate Taxiway F at Lawton/Fort Sill Regional Airport. 24-1921

  35. 27. Consider waiving Council Policy 1-6 to reconsider an item within 6 months, consider rescinding Resolution No. 24-187, which declared the structure(s) located at 1913 NW Lincoln Avenue a dilapidated structure, and take action as deemed necessary. 24-1915

Consideration and action upon a Resolution of the City of Lawton, Oklahoma (the “City”), approving and authorizing the modification of terms regarding a sales tax revenue note Series 2024C (the “Note”) to be issued by the Lawton Industrial Development Authority (the “Authority”); and all matters related thereto. 24-1907

Consider holding a public hearing and approving an ordinance pertaining to Planning and Zoning amending Section 18-1-1-106, Division 18-1-1, Article 18-1 and Section 18-6-16-671, Division 18-6-16, Article 18-6 both of Chapter 18, Lawton City Code, 2015 by creating a definition for blockchain, digital asset, digital asset mining, home digital asset mining, and node; and allowing digital asset mining businesses to be a permitted use within an I-1 Restricted Manufacturing and Warehouse District; providing for severability and establishing an effective date. 24-1899

Consider holding a public hearing and approving an ordinance pertaining to Planning and Zoning amending Section 18-4-1-411, Division 18-4-1, Article 18-4, Chapter 18, Lawton City Code, 2015 by allowing home digital asset mining as a home occupation; providing for severability and establishing an effective date. 24-1900
  40. 31. Receive a report from Parks and Recreation regarding playground equipment for 9 parks and consider accepting a SPARK Grant from Play&Park Structures in the amount of $928,544.00 for the purchase of the playground equipment as presented. 24-1901
  41. 32. Consider adoption of revised Neighborhood Traffic Calming Policy, adopting as Council Policy 10-05. 24-1887

  44. 34. Receive a report on the status of the relocation program for prairie dogs within the city of Lawton to wildlife management areas within the state of Oklahoma. 24-1919
  45. 45 EXECUTIVE SESSION ITEMS:

Pursuant to Section 307B.4, Title 25, Oklahoma Statutes, consider convening in executive session to discuss the pending action in the United States District Court for the Western District of Oklahoma titled Andre Wilson vs City of Lawton, et al, CIV-24-853-G, and if necessary, take appropriate action in open session. 24-1898
  47. 47 ADJOURNMENT
  48. 48 The City of Lawton encourages participation from all of its citizens. If participation at any public meeting is not possible due to a disability, notification to the City Clerk at (580) 581-3305 at least 48 hours prior to the scheduled meeting is encouraged to make the necessary accommodations. The City may waive the 48 hour rule if interpreters for the deaf (signing) is not the necessary accommodation."
