  16. 14 The Board engaged in discussion amongst themselves and with Presenter Steve Chevalier, Environmental Health Supervisor Connor Gerken, and County Attorney Monica Kovaci. The Homeowner of 23900 E. Ohio Ave. was not present in person or virtually for this hearing. Director Burrows vocalized concerns about possibility of criminal charges and scope of the sentencing guidelines permitting incarceration. County Atty. Kovaci clarified the intent to partner with other county departments such as Judicial, Public Works, and Law Enforcement to gain compliance through civil courts and did not intend to pursue criminal action against the homeowner. There was discussion speculating on the homeowners ability/desire to remedy the concerning onsite wastewater systems but The Board consistently returned to their duty to protect public health being paramount to their decision. Several directors expressed compassion towards the Homeowner and discussed various options to gain compliance, including the county paying for installation of fencing, whether the homeowner could continue using the septic system without further deterioration, and reducing the civil penalties amount to a judgment lien on the property. approved Pass
