CEQA: This project is categorically exempt under the California Environmental Quality Act Guidelines Section 15332, In-Fill Development Projects, as it involves development on a site that is five acres or less, is surrounded by urban uses, has no habitat value, is adequately served by all required utilities and public services, would not result in any significant effects on traffic, noise or air quality, and would be consistent with general plan and zoning regulations.   23. 23 CONDUCT A PUBLIC HEARING AND RECOMMEND ADOPTION OF THE CITY OF SAN PABLO SUSTAINABLE TRANSIT ORIENTED DEVELOPMENT (TOD) MASTER PLAN CEQA: The Plan is statutorily exempt from CEQA under the provisions of Senate Bill 288 which established an exemption from environmental review pursuant to Public Resources Code sections 21080.20 and 21080.25 for pedestrian and bicycle facilities, projects that improve customer information and wayfinding for transit riders, bicyclists, and pedestrians, and transit prioritization projects. This exemption is applicable to the proposed Plan because it is being carried out by a public agency, it is located in an urbanized area, and it describes projects that would be on or within an existing public right-of-way. In addition, the Plan would not add new automobile capacity or require the demolition of affordable housing units; and the Plan would not involve project costs that would exceed $100 million.
