Conditional Use Permit (CUP-22538-2023) Project Address: 1000 Walnut Avenue Project Applicant: Exeter 1000 Walnut LLC Project Planner: Ata Khan Council District: CC District No. 3 Request to establish an outdoor storage yard on a property in the M-1 Light Industrial Zoning District. Pursuant to the provisions of CEQA (Public Resources Code, Section 21084 et. seq.), the guidelines include a list of classes of projects which have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA. The Planning Commission will consider adopting a Class 1 Categorical Exemption in compliance with Section 15301 - Existing Facilities at the public hearing as part of this action. Recommendation: Staff recommends that the Planning Commission approve the request as conditioned by Staff in the attached draft Resolution.
- 10 2. Development Plan Review (DPR 72-2024) (Remanded to Planning Commission on May 16, 2024 at Development Plan Review Hearing) Project Address: 3101-3191 N. Garey Avenue Project Applicant: Matthew Cobo, AIA as agent for AC Martin, Inc. Project Planner: Alex Jimenez Council District: CC District No. 6 A request to develop 289 dwelling units in two, four-story buildings on a 5.5 acre site, with the following on-site and off-site improvements: utilities, parking, lighting, landscaping, common space, private space, and privately-owned public open space. The site is currently developed with a commercial shopping center that will be demolished to accommodate the project. The units consists of 120 one-bedroom units, 155 two-bedroom units and 14 three-bedroom units, all units are rental units. The subject property is located in the City Gateway Segment of the Pomona Corridors Specific Plan (PCSP). The City of Pomona, as lead agency, has conducted an environmental review on the proposed project per the California Environmental Quality Act (CEQA). Staff has determined that the proposed project meets the criteria for Exemption pursuant to Section 15182 of CEQA in that the proposed project is a residential project consisting of 289 dwelling units and is undertaken pursuant to and in conformity with the PCSP adopted in 2014. The proposed residential use and density was contemplated in the EIR certified for the PCSP EIR and was evaluated as part of that environmental analysis. Therefore, no further environmental review is required. Recommendation Staff recommends that the Planning Commission adopt the attached draft Resolution No. 24-009 approving Development Plan Review (DPR-72-2024), subject to conditions.

Towne Avenue (APN: 8331-016-024) Project Applicant: Syed Raza & Associates Project Planner: Alex Jimenez Council District: CC District No. 3 A request to develop a vacant lot more than 20,000 sf in area with two commercial buildings (Building A is 3,314 sf and Building B is 1,423 sf) with on-site and off-site improvements, in the in the C-4 Highway Commercial Zone and SB 330 Overlay. Pursuant to the provisions of CEQA (Public Resources Code, Section 21084 et. seq.), the guidelines include a list of classes of projects which have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA. The Planning Commission will consider adopting a Class 3 Categorical Exemption in compliance with Section 15303 - New Construction or Conversion of Small Structures at the public hearing as part of this action. Recommendation: Staff recommends that the Planning Commission approve the request as conditioned by Staff in the attached draft Resolution No. 24-010.
