SUBJECT: Zoning Ordinance Amendment #20-02, initiated by the City of Merced. This application involves changes to the Merced Zoning Ordinance (Title 20 of the Merced Municipal Code) which would amend Merced Municipal Code Section 20.42 (“Accessory Dwelling Units”). This amendment would modify the City’s requirements for “accessory dwelling units” (ADUs) to meet the modified requirements of State Law in regards to minimum lot sizes, owner-occupancy requirements, maximum size of an ADU, application review times, parking requirements, the charging of impact fees, the sale of ADUs, “junior ADUs,” and other requirements of State Law. **PUBLIC HEARING** ACTION PLANNING COMMISSION: Recommendation to City Council Environmental Review #20-34 (Categorical Exemption) Zoning Ordinance Amendment #20-02 CITY COUNCIL: Approve/Disapprove/Modify Environmental Review #20-34 (Categorical Exemption) Zoning Ordinance Amendment #20-02 SUMMARY This Zoning Ordinance Amendment would modify the City’s requirements for “accessory dwelling units” (ADUs) to meet the modified requirements of State Law in regards to minimum lot sizes, owner-occupancy requirements, maximum size of an ADU, application review times, parking requirements, the charging of impact fees, the sale of ADUs, “junior ADUs,” and other requirements of State Law, which have gone into effect in 2020 and 2021. Staff is recommending approval. RECOMMENDATION Planning staff recommends that the Planning Commission recommend approval to the City Council of Environmental Review #20-34 [Categorical Exemption] and Zoning Ordinance Amendment #20-02 (including the adoption of the Draft Resolution at Attachment A) subject to the findings/considerations in Exhibit A of the Draft Resolution.
