SUBJECT: Approval of a Fee Agreement with Rutan & Tucker, LLP to Provide Legal Services in Casey Steed and Merced Smart Growth Advocates v. City of Merced, et al. to be Funded by Merced Holdings, L.P. in Accordance with the Conditions of Approval for the Development Project Located at Yosemite and McKee and Acceptance of Funds for Legal Expenses from the Developer and Authorization for Continuous Appropriation to the Legal Liability Fund Until Final Disposition of the Case REPORT IN BRIEF Recommends approving a fee agreement with Rutan & Tucker, LLP to provide legal services on behalf of the City in the case Casey Steed and Merced Smart Growth Advocates v. City of Merced, et al. and authorizes appropriation of funds for legal expenses received from the Developer to the Liability Fund. RECOMMENDATION City Council - Adopt a motion: A. Approving the fee agreement with Rutan & Tucker; and, B. Affirming the Authority of the City Manager to execute the agreement; and, C. Accepting an initial deposit of $10,000 from Merced Holdings, L.P. and increasing revenue account 667-0411-331.01-11, project 304651 and authorizing appropriation of the same to account 667-0411-512.30-12, Project 304651; and, D. Authorizing any receipts of funds for legal expenses from Merced Holdings, L.P. related to Project 304651 to be approved for continuous increases to revenue in account 667-0411-331.01-11 and appropriation in account 667-0411-512.30-12 until final disposition of the case; and, E. Authorizing the Finance Officer to make the necessary budget adjustments.
