- 16 JOINT CONSENT CALENDAR
- 1. Recommended Action: It is recommended that the City Council approve the Draft Minutes from the Regular Meeting held Tuesday, September 3, 2024.
- 2. Recommended Action: It is recommended that the Council/Board ratify the warrant run and payroll report for the City, Successor Agency to the Hesperia Community Redevelopment Agency, Hesperia Housing Authority, Community Development Commission, and Water District.
- 3. Recommended Action: It is recommended that the Council/Board accept the Treasurer’s Cash Report for the City, Successor Agency to the Hesperia Community Redevelopment Agency, Hesperia Housing Authority, Community Development Commission, and Water District.
- 4. Recommended Action: It is recommended that the City Council authorize the City Manager to enter into an agreement with NBS Government Finance Group (NBS) in an amount of $25,000, to provide professional services related to the Community Facilities District (CFD) 2005-1 (Belgate Development Restructuring) Special Tax, Series 2014 Bond Refunding. As this agreement is solely related to the refinancing of a debt issue, if approved, the agreement would be separate from other existing agreements with NBS totaling $200,000 for ongoing services related to CFD formation, assessment district administration, and annexation services, for CFD 2005-1, CFD 2021-1, CFD 2022-1, and CFD 2023-1.
- 5. Recommended Action: It is recommended that the City Council and Water District Board adopt the Fair Political Practices Commission required biennial update of the City’s Statement of Economic Interest Employee Filing Roster (Conflict-of-Interest Code) for designated employees through adoption of Joint Resolution No. 2024-47 and HWD 2024-15.
- 6. Recommended Action: It is recommended that the City Council authorize the City Manager to approve a contract amendment in the amount of $34,952, plus a contingency of $968, for a total not-to-exceed amount of $130,204, to provide an additional year of licensing support and maintenance of the City’s current Electronic Document Management System (Laserfiche).
- 7. Recommended Action: It is recommended that the City Council and Board of Directors of the Hesperia Water District (District) authorize the City Manager to approve an amendment of $1,500,000 to the existing contract with General Pump Company for a not-to-exceed amount of $1,665,032 for the rehabilitation of five (5) water production wells.
- 8. Recommended Action: It is recommended that the City Council and Board of Directors of the Hesperia Water District authorize the City Manager to enter into an agreement with Ken Grody Ford for the purchase of two (2) 2024 Ford F-550’s with Scelzi utility bodies and cranes in the not-to-exceed amount of $263,200.
- 9. Recommended Action: It is recommended that the City Council and Board of Directors of the Hesperia Water District authorize the City Manager to enter into an agreement with Ferguson Waterworks for the purchase of thirty (30) remote pressure monitoring units in the not-to-exceed amount of $127,100.
- 10. Recommended Action: It is recommended that the City Council and Board of Directors of the Hesperia Water District authorize the City Manager to enter into an agreement with Doane & Hartwig Water Systems for the purchase of fourteen (14) reservoir mixers manufactured by Tidal Wave in the not-to-exceed amount of $162,000.

- 28 WAIVE READING OF ORDINANCES Approve the reading by title of all ordinances and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived.
- 11. Recommended Action: Place on second reading and adopt by title waiving the text of Ordinance No. 2024-09 approving Development Code Amendment DCA24-00001 and Specific Plan Amendment SPL24-00001 modifying the development requirements associated with the establishment of new or the expansion of existing single price overstock/discount stores (SPODS), and repealing Urgency Ordinance No. 2024-02.
- 30 PUBLIC HEARING

Speaker slips should be turned in prior to an agenda item being taken up. Comments will be limited to five minutes for Public Hearing items. - 12. Recommended Action: It is recommended that the City Council and the Board of Directors of the Hesperia Water District consider amending the City-wide fee schedule related to the User Fee Study, and the adoption of proposed Joint Resolution No. 2024-35 and Resolution HWD 2024-14.
- 13. Recommended Action: It is recommended that the City Council waive further reading and adopt Urgency Ordinance 2024-11 pursuant to California Government Code Section 65858 extending a moratorium for a period of ten (10) months and fifteen (15) days from its original expiration date on the establishment or expansion of wooden pallet yards, pending study and adoption of regulatory and zoning standards.
- 14. Recommended Action: It is recommended that the City Council conduct a public hearing and, upon accepting public testimony, 1) approve the Program Year (PY) 2023-2024 Consolidated Annual Performance Evaluation Report (CAPER); and 2) authorize the City Manager, or designee, to submit the PY 2023-2024 CAPER to the U.S. Department of Housing and Urban Development (HUD), along with any public testimony and changes thereto as directed by the City Council.
- 15. Recommended Action: It is recommended that the City Council hold a public hearing on the proposed Resolution of Necessity (Resolution 2024-45) and adopt the Resolution of Necessity authorizing the commencement of eminent domain action to acquire the real property located north of Yucca Terrace Drive abutting the California Aqueduct (Assessor Parcel No. 3064-461-03).
